<br />-2- <br /> <br />at least one wrecker with a minimum of one-ton capacity. A <br />second file shall consist of category "B" commercial towing <br />and wrecker services with at least one wrecker with a minimum <br />of four-ton capacity. When towing or wrecker services are <br />required, notice will be given to the commercial towing and <br />wrecker service then at the top of the rotation order for the <br />the appropriate category. The rotation system will apply to <br />one tow regardless of its nature, and then notification will <br />rotate to the next commercial towing and wrecker service <br />listed in that category. Any commercial towing or wrecker <br />service whose operator stops at the scene of any accident or <br />other incident without being notified by the police <br />dispatcher will be subject to suspension from the rotation <br />system; similar suspension shall also result to any wrecker <br />service called under the rotation system to an accident whose <br />operator removes a vehicle without properly cleaning the <br />location to include removal of all debris associated with <br />said accident. <br /> <br />Sec. 33-5 Solicitation. <br /> <br />Offices or employees of the San Marcos Police Department <br />shall not solicit, recommend or suggest any particular <br />commercial towing or wrecker service to any individual for <br />any purpose and shall not call any such service that is not <br />on the rotation system. However, when a personal request is <br />made by an individual for a particular commercial towing or <br />wrecker service, such request shall not alter the position of <br />that service in the rotation system. The name, address and <br />telephone number of the individual requesting a particular <br />towing or wrecker service shall be recorded by the <br />investigating officer and filed by the police department <br />dispatcher. <br /> <br />Sec. 33-6. Availability. <br /> <br />Each participating commercial towing and wrecker service must <br />be available to respond to Police Department calls on a <br />twenty-four hour per day basis and shall respond to any <br />location within the City of San Marcos within twenty (20) <br />minutes after being notified by Police Department <br />Communications personnel. In the event of mechanical <br />difficulty, illness, vacation or any other reason for <br />inability to respond as required, the commercial towing or <br />wrecker service shall so notify the Police Department <br />Communications Section and request not to be notified pending <br />further notice. While unable to respond, the rotation log <br />will be completed with "out of service" each time the wrecker <br />service's name occurs. When capability to respond has been <br />restored, said wrecker service shall notify the Police <br />Department Communications Section. If a wrecker or towing <br />service fails to respond to a call on three (3) occasions <br />during a six-month period or on two (2) occasions during a <br />three-month period, said service shall be removed from the <br />rotation for a period not to exceed thirty (30) days. <br /> <br />Sec. 33-7 Equipment. <br /> <br />Every wrecker shall be equipped with all equipment and <br />materials as specified and required by the Texas Department <br />of Labor and Standards Tow Truck Rules which are promulgated <br />under the authority of the Texas Tow Truck Act (Texas Civil <br />Statutes, Article 6687-9b). Any such wrecker shall be <br />subject to inspection at any time by any officer of the <br />police department. <br /> <br />Sec. 33-8 Records. <br /> <br />Records of services provided under this chapter shall be <br />maintained by each commercial towing or wrecker service for a <br />minimum period of one year and shall be made available for <br />inspection upon request by the Chief of Police or his <br />representative. Police Department Communications personnel <br />shall maintain an activity log of calls made on the rotation <br />
