<br />(b) <br /> <br />(c) <br /> <br />( d) <br /> <br />-4- <br /> <br />the operation 9f a commercial wrecker participating in <br />the rotation system of notification operated by the San <br />Marcos Police Department and shall be in the minimum <br />amounts of: <br /> <br />(1) Each tow truck with a gross vehicle weight of <br />26,000 pounds or less must carry $300,000 combined <br />single limit coverage. <br /> <br />(2) Each tow truck with a gross vehicle weight over <br />26,000 pounds must carry $500,000 combined single limit <br />coverage. <br /> <br />(3) Each tow truck with a gross vehicle weight 26,000 <br />pounds or less must carry cargo, on-hook or similar type <br />insurance in an amount not less than $10,000. Provided, <br />however, for satisfaction of the requirement for <br />insurance against damage to a towed vehicle, a surety <br />bond in the minimum amount of ten thousand dollars <br />($10,000.00) may be provided to the city. Said surety <br />bond shall be available for the satisfaction of any <br />valid final judgment against the commercial towing or <br />wrecker service for property damage to a vehicle towed <br />by said service pursuant to the terms of this chapter or <br />to satisfy any agreement between a towing service and a <br />claimant. <br /> <br />(4) Each tow truck with a gross vehicle weight over <br />26,000 pounds and a tandem axle must have tow truck <br />cargo or on-hook insurance for the coverage of a towed <br />vehicle in an amount not less than $25,000. Provided, <br />however, for satisfaction of the requirement for <br />insurance against damage to a towed vehicle, a surety <br />bond in the minimum amount of twenty-five thousand <br />dollars ($25,000.00) may be provided to the city. Said <br />surety bond shall be available for the satisfaction of <br />any valid final judgment against the commercial towing <br />or wrecker service for property damage to a vehicle <br />towed by said service pursuant to the terms of this <br />chapter or to satisfy any agreement between a towing <br />service and a claimant. <br /> <br />All commercial towing or wrecker services performing <br />services under the provisions of this chapter shall hold <br />the city harmless from all claims, actions and lawsuits <br />which may result from injury to persons and/or damages <br />to property caused by said commercial towing or wrecker <br />service, its agents, or employees. Any vehicle or <br />articles inside said vehicle shall be the sole <br />responsibility of the commercial towing or wrecker <br />service towing the vehicle. <br /> <br />All commercial towing or wrecker services performing <br />services under the provisions of this chapter shall <br />respond within ten (10) days to complaints about the <br />service performed or about damage to any vehicle while <br />it was towed or impounded by that service. The <br />commercial towing or wrecker service shall respond in <br />writing to the person complaining and to the Chief of <br />Police of the City of San Marcos. If the Chief of <br />Police ùt::n..d.L1ninel:) i:.ílal.; ùc:Ullages should be paid, the <br />commercial towing or wrecker service shall pay the <br />damages in full within thirty (30) days of receipt of <br />the complaint or within fifteen (15) days of the police <br />chief's decision. <br /> <br />Penalty for failure to comply with this Section shall be <br />removal from the rotation system for a period not to <br />exceed thirty (30) days from and after compliance is <br />achieved. <br />
