<br />requirements <br /> <br />for <br /> <br />the <br /> <br />project(s) . <br /> <br />Such <br /> <br />information <br /> <br />may <br /> <br />include <br /> <br />a <br /> <br />program, <br /> <br />which <br /> <br />shall <br /> <br />set <br /> <br />forth <br /> <br />the <br /> <br />CITY's <br /> <br />design <br /> <br />objectives, <br /> <br />constraints and criteria, including space requirements and <br /> <br />relationships, <br /> <br />flexibility and expandability, <br /> <br />special equipment <br /> <br />and <br /> <br />systems and site requirements. <br /> <br />2.2 <br /> <br />I f the CITY provides a budget for the pro j ect ( s ) <br /> <br />it shall <br /> <br />include <br /> <br />contingencies <br /> <br />for <br /> <br />bidding, <br /> <br />changes <br /> <br />in the Work during <br /> <br />construction, and other costs which are the responsibility of the CITY, <br /> <br />including those described in this Article 2 and in Subparagraph 3.1.2. <br /> <br />The <br /> <br />ARCHITECT <br /> <br />shall <br /> <br />accept <br /> <br />the <br /> <br />CITY's <br /> <br />authorization <br /> <br />to <br /> <br />bid <br /> <br />the <br /> <br />project(s) as evidence that arrangements exist for fulfillment of the <br />financial obligations assumed by the CITY hereunder. <br /> <br />2.3 <br /> <br />The CITY shall designate a representative authorized to act <br /> <br />in the CITY's behalf with respect to the project(s). <br /> <br />The CITY and/or <br /> <br />such authorized representative shall examine the documents submitted by <br /> <br />the ARCHITECT and shall render responses pertaining thereto promptly <br /> <br />and provide <br /> <br />ARCHITECT <br /> <br />with <br /> <br />requested data or information in CITY's <br /> <br />possession relating to the project(s). <br /> <br />2.4 <br /> <br />The CITY shall provide access <br /> <br />to and make all <br /> <br />necessary <br /> <br />provisions for the ARCHITECT to enter upon public and private property <br /> <br />as <br /> <br />required <br /> <br />for the ARCHITECT to perform its <br /> <br />services <br /> <br />under this <br /> <br />Agreement. <br /> <br />2.5 <br /> <br />The CITY shall furnish geotechnical, structural, mechanical, <br /> <br />chemical <br /> <br />and <br /> <br />other <br /> <br />laboratory <br /> <br />tests, <br /> <br />inspections <br /> <br />and <br /> <br />reports <br /> <br />as <br /> <br />required by law or the construction contract documents or as reasonably <br /> <br />needed by the ARCHITECT. <br /> <br />The ARCHITECT shall not be held responsible <br /> <br />for its reliance on any such information supplied by CITY provided that <br />ARCHITECT does not know or reasonably cannot be expected to know of any <br /> <br />deficiency or error in such information supplied by CITY. <br /> <br />2.6 <br /> <br />The CITY shall furnish all legal, accounting and insurance <br /> <br />counseling services as may be necessary at any time for the Project(s), <br /> <br />including such auditing services as the CITY may require to ascertain <br /> <br />how or for what purposes the Contractor uses the money paid by or on <br /> <br />behalf of the CITY. <br /> <br />-10- <br />
