AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, RENUMBERING SECTIONS 21-1 AND 21-2 OF ARTICLE IOF CHAPTER 21, PUBLIC SAFETY, OF THE CODE OF ORDINANCES OF SAID CITY, TO SECTIONS 21-2 AND 21-3, RESPECTIVELY, ADDING A NEW SECTION 21-1 THERETO TO CREATE A PUBLIC SAFETY DEPARTMENT WITHIN WHICH ARE THE POLICE AND FIRE DIVISIONS OF SAID CITY', AMENDING SECTIONS 21-2 AND 21-3 THEREOF TO PROVIDE THAT THE POLICE CHIEF AND FIRE CHIEF RESPECTIVELY, SHALL REPORT iIRECTLY TO THE DIRECTOR OF PUBLIC SAFETY, AMENDING !ECTION 21-13 OF ARTICLE II, SECTION 21-22 OF ARTICLE iIl/2, AND SECTION 21-25 OF ARTICLE III THEREOF TO ~MEND THE CITATION TO STATUTORY AUTHORITY TO COMPLY ~ITH CHANGED STATE LAW, AND DECLARING AN EFFECTIVE ~ JiATE . ati ~åWHEREAS, the position of Director of Public Safety was created and ggfi~1id in 1985 by the City Council; and, ~ w.,¡,iJ;¡ ~ €5 ~_WHEREAS, a Department of Public Safety was assumed but not created f~£ial1Y since that time; and, ~~ WHEREAS, lines of authority between the Director of Public Safety and the Police Chief and Fire Chief have not been clearly defined; and, CD co ~ ORDINANCE 1988-69 81 WHEREAS, the formal creation of a Department of will be beneficial to the City at this time, and; Public Sa fety WHEREAS, the City Manager may recommend changes and realignments to the City Council for the Department of Public Safety in the future, as circumstances warrant; and, WHEREAS, it is in the interest of the City to establish clear lines of authority and responsibility with respect to the Police Chief, the Fire Chief, the Director of Public Safety and the City Manager in order to improve the management of those governmental functions and carry out the policies of the City Council; now, therefore, BE TEXAS: IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, SECTION 1. That Sections 21-1 and 21-2 of Article I of Chapter 21 of the Code of Ordinances of said City shall be renumbered Sections 21-2 and 21-3, respectively. SECTION 2. That new Section 21-1 shall be added to Article I of Chapter 21 of the Code of Ordinances of said City and shall read as follows: Se c. 2 1-1 . Public Safety Department Created. There is hereby created a Department of Public Safety within the City of San Marcos, the head of which shall be the director of public safety. The director of the Department of Public Safety shall be the City Manager or the Assistant City Manager. SECTION 3. That Section 21-2 of Article I of said Chapter of said Code is hereby amended to provide that the police chief shall report "directly to the director of public safety." SECTION 4. That Section 21-3 of Article I of said Chapter of said Code is hereby amended to provide that the fire chief shall report "directly to the director of public safety." SECTION 5. That the citations to certain statutory authority appearing in Section 21-13 of Article I~ of said Chapter of said Code as "Article l269m, Texas Revised Civil Statutes" and "Section 15 of Article l269m", shall be amended to read "Chapter 143, Local Government Code, V.T.C.A." and "Section 143.013, Local Government Code, V.T.C.A.," respectively.
