<br />-5- <br /> <br />pretreatment structure planned by the person, or in use <br />by the person, is suitable for the purpose intended. <br />However, the approval of plans by the Director will in no <br />way relieve a person of the responsibility for modifying <br />the structure once constructed as necessary to produce an <br />effluent acceptable to the Director under the terms of <br />this Ordinance. <br /> <br />(13) Removal Credits. Any industry wishing to apply for <br />removal credit as described in Title 40, Code of Federal <br />Regulations, Part 403, may do so provided it assumes <br />responsibility for all costs incurred, including those by <br />the City, and states this responsibility to the Director <br />in writing. Any removal credit granted shall be <br />in accordance with the procedures set forth in Title 40, <br />Code of Federal Regulations, Part 403, as amended. <br /> <br />PART 9. That Chapter 30, Article III, New Section 30-93, <br />Subsection (11) "Special Procedures Relating to Industrial Wastes" <br />is amended as follows: <br /> <br />Sec. 30-93. <br /> <br />Special Procedures Relating to Industrial Wastes. <br /> <br />. . . <br /> <br />(11) Rules and Procedures. The Director shall adopt rules and <br />procedures (Procedures Manual) consistent with this <br />Ordinance, to effectuate its purpose and intent. The <br />rules and procedures are adopted hereby and incorporated <br />by reference herein and a copy of which shall be <br />maintained in the office of the City Secretary of the <br />City of San Marcos. The rules and procedures shall <br />consider the quantity, quality and means of disposal of <br />industrial wastes and the geographic, topographic, and <br />physical construction factors and treatment methods in <br />the waste collection and disposal systems and the <br />beneficial uses of the water in these systems or of <br />waters receiving the discharge and any other matter <br />relevant to the implementation of this Ordinance. <br />Failure to comply with the rules and procedures shall be <br />a violation of this Ordinance as set out in Section <br />30-99 of this Ordinance. <br /> <br />PART 10. That Chapter 30, Article III, Section 30-95, <br />Monitoring for Surcharge and Removal Credit Determination, is deleted. <br /> <br />PART 11. That all sections of <br />renumbered in proper sequential order. <br /> <br />Chapter 30, Article III, are <br /> <br />PART 12. That Chapter 30, Article III, new section 30-94(1) is <br />hereby amended as follows: <br /> <br />Sec. 30-94. <br /> <br />Chemical Disclosure, Classified Data and <br />Confidential Information. <br /> <br />(1) Any person not otherwise exempted shall file with the <br />Director a listing of all chemicals and compounds <br />included under Sec. 30-91, stored, used, processed or <br />transported to or from any location within the City. <br />Lists shall include the chemical name, chemical <br />composition and common name (if any) and name of <br />manufacturer, including those chemicals not subject to <br />discharge or pretreatment as described in any other <br />section of this Ordinance. <br /> <br />PART 13. That this Ordinance shall be in effect ten (10) days <br />from and after its passage, and it shall be published in a newspaper of <br />general circulation in the area as required by the Charter of the City <br />of San Marcos, Texas. <br /> <br />PASSED AND APPROVED on first reading <br /> <br />September 12, 1988. <br />
