<br />C. NATIONAL PROGRAM OBJECTIVES <br /> <br />Each activity proposed for funding under the Community Development Fund <br />or the Special Impact Fund, must address one or more of the following national <br />program objectives outlined in Title I of the Housing and Community <br />Development Act of 1974, as amended. These are: <br /> <br />Principally benefits persons of low/moderate income (i.e., at least 51 <br />percent of the persons benefitting from the project must be of low and <br />moderate'income as defined for the HUD Section 8 housing assistance <br />program). HUD Section 8 income limits are provided in Appendix VI for <br />applicants using the TCDP survey instrument. <br /> <br />Prevents or eliminates slum and blight conditions. <br /> <br />The following is set forth as the definition of "Slum and Blight" to <br />qualify an application for consideration for funding under the Texas <br />Community Development Program: <br /> <br />Substandard structures may be used to establish a slum and blighted area <br />(one or more) within the corporate limits of a city if the designated <br />area constitutes less than all of the geographic area within the <br />corporate limits of a city and one or more of the following exist: <br /> <br />a) <br /> <br />the area is designated as a reinvestment zone pursuant to TEX. TAX <br />CODE, Chapter 311 (Tax Increment Finance Act) or TEX. TAX CODE, <br />Chapter 312 (Tax Abatement Act); or <br /> <br />the area is designated as an enterprise zone by the Texas Department <br />of Commerce (based in whole or in part on substandard structures); or <br /> <br />b) <br /> <br />c) <br /> <br />twenty-five percent (25%) or more of the structures in the area <br />designated are found by the governing body of a city to constitute <br />substandard, slum, deteriorated, or deteriorating structures as <br />defined by local law. If local law does not define what constitutes <br />a substandard, slum, etc., structure, a city may consider as <br />substandard any structure which: <br /> <br />(I) is abandoned; or <br />(2) does not have plumbing; or <br />(3) has been condemned or cited for building or fire code <br />violations by appropriate Gity authority; or <br />(4) is in an inadequate state of repair under applicable public <br />health, safety, fire, or building codes; or <br />(5) is the subject of a tax or special assessment delinquency <br />stated as a percentage of total taxes assessed, which exceeds <br />the fair market value of the land involved and the improvements <br />thereon; or <br />(6) is functionally or economically obsolete as determined by a <br />qualified appraiser. <br /> <br />15 <br />
