<br />standards. The City agrees that it shall not take any action <br />that will impair the District's use of such utilities <br />service. The District will adopt a rate schedule, rules and <br />regulations for use of the system, and various policies <br />including drought prevention measures. <br /> <br />Section 4. 09. Capaci tv Reauirements. It is acknowl- <br />edged and agreed that for purposes of preliminary planning <br />the District is entitled to approximately 3,252 living unit <br />equivalents ("LUEs") of capacity in the City's utility <br />systems at full District build-out as reflected in the <br />Utility Plan. The City acknowledges that the District needs <br />capacity according to the schedule of build-out it currently <br />projects, but acknowledges that the District's capacity <br />requirements may change. The City agrees to make any such <br />required capacity available, and the District agrees to <br />compensate the City therefor in accordance with this Amended <br />Agreement. If at any time the capacity required by the <br />District is not available from the City, the City will <br />provide temporary or alternative sources of utility service, <br />or the City will agree to construction by the District of a <br />portion of the Regional Facilities such that service to the <br />District is not disrupted. <br /> <br />Section 4.10. Water Usage and Measurement. At the <br />times requested by the District, the City agrees to sell and <br />deliver to the District all water which may reasonably be <br />required for domestic and commercial purposes by users within <br />the District, at the rate the City charges its in-city retail <br />customers and the District shall pay the City's water <br />charges. Metering equipment and related facilities, <br />including standard-type devices required for properly <br />measuring the quantity of water delivered to a retail <br />customer shall be installed at each customer's delivery point <br />according to then current City policies and charges. The <br />City shall not establish water provision procedures which <br />differentiate charges or practices between in-city and <br />out-of-City customers. Nothing herein shall preclude the <br />District from charging tap fees. If at any time the said <br />City policy and this Amended Agreement conflict, this <br />Amended Agreement shall control. The City, at its expense, <br />shall operate and maintain the metering equipment and related <br />facilities and shall calibrate the metering equipment. <br /> <br />-13- <br />
