<br />section 4.11. Water and Wastewater Rates and Billing. <br />The City shall bill and collect water and wastewater charges <br />from customers in the District according to the same policies <br />and on the same basis as its customers within its corporate <br />limits. The City shall not establish procedures which <br />differentiate between in-city and out-of-City customers. <br />Rates charged to customers wi thin the District for water <br />supply and wastewater collection and treatment service and <br />for billing and collection services shall be set by the <br />District and the rate the City charges its retail in-city <br />customers may be considered by the District in setting its <br />rates. From time to time a maintenance tax and/or <br />administrative fee may be levied by the District on customers <br />within the District and the City agrees to collect same and <br />deliver such revenues to the District. Invoices to customers <br />in the District shall be sent by the City, and each customer <br />inside the District shall pay the city. The city agrees that <br />its records on customers within the District shall be open to <br />inspection by the District's auditors. <br /> <br />Section 4.12. Water Conservation. The District agrees <br />to adopt water conservation measures as described in <br />Exhibit E hereto. <br /> <br />Section 4.13. certificate of Convenience and Necessity. <br />The District agrees to use its best efforts to secure a <br />Certificate of Convenience and Necessity from the Commission <br />to clarify the boundaries of the District's service area. <br />Should the District fail to secure such certificate, the City <br />is not relieved of its obligations under this Amended Agree- <br />ment. <br /> <br />ARTICLE FIVE <br /> <br />PARK FACILITIES, SOLID WASTE COLLECTION <br />AND DISPOSAL, AND FIRE PROTECTION SERVICE <br /> <br />Section 5.01. Park and Recreation Facilities. The City <br />agrees that the District may develop, operate and maintain <br />public parks and recreational facilities in accordance with <br />Section 54.771 through 54.775, Texas Water Code. The parties <br />agree that the District may own the public parkland <br />established pursuant to the city's Subdivision Ordinance then <br />in effect and any improvements constructed thereon by LRL or <br /> <br />-14- <br />
