<br />by the District until such time as the City desires to assume <br />ownership and operation and maintenance responsibility. The <br />District is not required to operate and maintain any parkland <br />or park or recreational facilities thereon that it does not <br />own. Nothing herein shall be deemed to preclude <br />establishment of additional recreational areas and improve- <br />ments outside the terms of this Amended Agreement. <br /> <br />Section 5.02. Solid Waste Collection Service. The <br />District and the City agree that the city will provide solid <br />waste collection and disposal services for the District <br />through the City's existing regional solid waste collection <br />and disposal program. The District may establish a fee for <br />such service equal to the City's basic fee established by <br />ordinance in effect on the date of such service from the <br />City's solid waste collection and disposal system. <br /> <br />Section 5.03. Fire-Fiqhtinq Service. The District <br />shall submit a plan for provision of fire-fighting services <br />to the Commission for approval, and if approved, after the <br />requisite public hearing, to place the plan and approval of <br />bonds and a tax levy on a ballot for a vote. If the District <br />authorizes construction or purchase of any fire-fighting <br />facilities the City reserves the right to approve any plans <br />and specifications or purchase. Such facilities will be ded- <br />icated to the City upon annexation of the District, and may <br />be used at the City's option by the currently existing fire <br />prevention entity serving the area in which the District is <br />located pursuant to a lease agreement entered into by such <br />entity, the District and the City, who shall be the owner of <br />the site for such facilities, or, in the alternative by the <br />City, if the City chooses to provide fire-fighting service to <br />the District. Only a nominal lease payment may be required <br />by the city. If the City chooses to provide such service, <br />the parties must agree to reasonable compensation for the <br />City. <br /> <br />ARTICLE SIX <br /> <br />ANNEXATION <br /> <br />Section 6.01. Annexation by the City. The City hereby <br />agrees that it will not annex the land within the District or <br />any portion thereof prior to the completion of 92.5% of <br /> <br />-15- <br />
