<br />construction of both the District's pro rata share of the <br />Regional Facilities and the District's internal facilities <br />necessary to serve the District at full build-out and the <br />purchase thereof by the District from the developer of the <br />property within the District, if applicable, or the ex- <br />piration of twenty (20) years from the date of the District's <br />creation, whichever occurs first. <br /> <br />Section 6.02. city Services. The land within the <br />District shall not be entitled to or receive City services <br />unless and unti I annexed into the City; provided, however, <br />any services provided to the property within the District <br />described herein are provided by the authority of this <br />Amended Agreement and any additional services provided in the <br />future will be pursuant to additional contracts, and all such <br />services are to be considered contractual rights rather than <br />entitlements. <br /> <br />Section 6.03. Non-incorDoration. LRL agrees to the <br />extent allowed by law that, except upon written consent of <br />the City, it will not seek or support any attempt to <br />incorporate any land within the District or sign any petition <br />seeking to do so. <br /> <br />ARTICLE SEVEN <br /> <br />LAND AND EASEMENT COSTS FOR REGIONAL FACILITIES <br /> <br />Section 7.01. Reqional Facilities. The parties agree <br />that the acquisition of land, easements, and rights-of-way <br />outside the District required ~y the City for the Ci ty' s <br />regional water and wastewater systems shall be the respon- <br />sibility of the City and acquisition thereof shall proceed as <br />expeditiously as possible. The District agrees to pay its <br />pro rata share of land acquisition costs based on its <br />percentage of capacity in the component or segment of the <br />Regional Facilities which crosses or benefits from each land <br />acquisition upon receipt of an invoice for such cost from the <br />City or its agent the Project Manager. <br /> <br />Section 7.02. District Purchase. In the event the City <br />is unable or unwilling to secure the required land, <br />easements, or rights-of-way for Regional Facilities on the <br />District's required schedule, the District may pay for same, <br /> <br />-16- <br />
