<br />28 <br /> <br />RESOLUTION 1988-116R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN MARCOS APPROVING THE TERMS <br />AND CONDITIONS OF A LETTER OFFERING <br />ALTERNATIVE METHODS OF UTILIZING PACKAGE <br />PLANT RESERVATIONS, AUTHORIZING THE CITY <br />MANAGER TO EXECUTE SAID LETTER ON BEHALF <br />OF THE CITY OF SAN MARCOS, DIRECTING THE <br />DIRECTOR OF PUBLIC WORKS TO DELIVER SAID <br />LETTER TO ALL PERSONS AND ENTITIES WITH <br />PACKAGE PLANT RESERVATIONS NOT YET <br />UT ILl ZED, AND DECLARING AN EFFECT IVE <br />DATE. <br /> <br />WHEREAS, the Ci ty of San Marcos did on September 14, 1984 <br />send letters of Invitation, understanding and Agreement for <br />Reservation of Wastewater Package Plant Capaci ty to persons and <br />enti ties interested in developing property in San Marcos wherein <br />the process by which temporary package plant capaci ty could be <br />reserved while a new sewer treatment plant was under construction; <br />and, <br /> <br />WHEREAS, many developers did participate in said process and <br />reserve package plant capacity; and, <br /> <br />WHEREAS, the sewer treatment plant is now fully operational <br />and the temporary package plants are no longer in use; and, <br /> <br />WHEREAS, many participating developers have not yet utilized <br />their reservations pursuant to the agreement outlined in said <br />letter of September 14,1984; and, <br /> <br />WHEREAS, the City of San Marcos desires to encourage <br />development and utilization of said package plant reservations; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COONC.IL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the terms and conditions of a letter offering <br />al ternati ve methods of uti 1 i zing package plant reservations, a <br />copy of said letter of offer being attached hereto and made a part <br />hereof, are hereby approved. <br /> <br />PART 2. That the Ci ty Manager of the Ci ty of San Marcos, <br />Larry D. Gilley, is authorized to execute said letter of offer on <br />behal f of said ci ty to all persons and entities that purchased <br />reservations of package plant capacity in 1984. <br /> <br />PART 3. That the Director of Public Works of the City of San <br />Marcos, George Boeker, is directed to del i ver said letter to all <br />persons and entities with package plant reservations not yet <br />utilized. <br /> <br />PART 4.
