<br />SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE
<br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF
<br />BUILDINGS, STRUCTURES AND LAND, DATED JUNE 13, 1984
<br />(VOL. 66) BY ZONING LOTS 12-21,23-33 AND 36-45 OF THE
<br />J.M. STONE ADDITION TO THE CITY OF SAN MARCOS, TEXAS,
<br />AS RECORDED IN VOLUME 52, PAGE 438 OF THE HAYS COUNTY
<br />DEED RECORDS; LOT 46A OF A REPLAT OF LOTS 46 AND 47 OF
<br />THE J.M. STONE ADDITION TO THE CITY OF SAN MARCOS,

<br />ALSO BEING A PART OF LOTS NOS. TEN (10), ELEVEN (11) AND
<br />TWENTY-FOUR (24) OF THE JACK THOMAS SECOND ADDITION TO
<br />THE CITY OF SAN MARCOS LOCATED IN THE VICINITY OF
<br />MARTIN LUTHER KING DRIVE, FARIS, MITCHELL, DAILY,
<br />MEAD, JOHNSON AND WI LSON STREETS FROM "MF-4" (MU LTI-
<br />FAMI LY DISTRICT-HIGH DENSITY) AND "R-l" (SINGLE FAMI LY
<br />DWELLING DISTRICT-LO~J DENSITY) TO "DP-l" (DUPLEX
<br />DISTRICT-LOW DENSITY) AND DECLARING AN EFFECTIVE
<br />DATE.
<br />
<br />WHEREAS, on February 3, 1987, the Zoning Commission of the
<br />City of San Marcos held a public hearing regarding a request to
<br />change the zoning from "MF-4" (Multi-Family District-High-Density)
<br />and "R-l" (Single-Family Dwelling District-low Density) to "DP-l"
<br />(Duplex District-low Density) of Lots 12-21, 23-33 and 36-45 of
<br />the J.M. Stone Addition; lot 46A of a replat of Lots 46 and 47 of the
<br />J.M. Stone Addition; Lots 1-8 of the Whisenant Addition; Lot 9 of the
<br />Jack Thomas Second Addition; Lots 9 and 10 of the Alex Glasscock
<br />First Addition; Block 2, Lots 1-6 and Block 3, Lots 1-6 of the J.B.
<br />Wilson First Addition and 0.344 acres out of the J.M. Veramendi
<br />League No.1 also being a part of Lots Nos. 10, 11 and 24 of the
<br />Jack Thomas Second Addition to the City of San Marcos, Hays County,
<br />Texas; and,
<br />
<br />WHEREAS, subsequent to said
<br />Zoning Commission did, on February
<br />vote to approve the same and
<br />request be approved by the
<br />City; and,
<br />
<br />public hearing on said date, said
<br />3, 1987, consider said request and
<br />has recommended that such
<br />City Council of said
<br />

<br />WHEREAS, said City Council held a public hearing on the
<br />November, 1988, regarding such request; and,

<br />WHEREAS, all requirements of Appendix A, General Zoning
<br />Ordinance, of the Code of Ordinances of the City of San Marcos
<br />pertaining to amendments have been met; and,
<br />
<br />WHEREAS, said City Council hereby finds and determines that the
<br />adoption of the following ordinance is in the interest of the public
<br />health, morals, welfare and safety; now, therefore,
<br />
<br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF

<br />TEXAS:

<br />SECTION 1. That the following described tracts of real property
<br />located in San Marcos, Hays County, Texas, which is presently
<br />zoned "MF-4" (Multi-family District-High Density) and "R-l" (Single
<br />Family Dwelling District-Low Density) be rezoned to "DP-l"
<br />(Duplex District-low Density):

<br />Lots 12-21,23-33 and 36-45 of the J.M. Stone Addition; to
<br />the Ci ty of San Marcos, Texas, as recorded in Volume 52, Page
<br />438 of the Hays County Deed Records; Lot 46A of a replat of Lots
<br />46 and 47 of the J.M. Stone Addition to the City of San
<br />Marcos, Texas, as recorded in Volume 3, Page 230 of the Hays
