<br />64 <br /> <br />GRANT <br /> <br />This AGREEMENT is made <br /> <br />between the CITY OF SAN MARCOS, TEXAS, <br /> <br />hereinafter referred to as "OWNER", 630 East Hopkins, San Marcos, Texas <br /> <br />78666, and PRO-TECH ENGINEERING GROUP, INC., 100 E. San Antonio Street, <br /> <br />Suite <br /> <br />100, <br /> <br />San <br /> <br />Marcos, <br /> <br />Texas <br /> <br />78666, <br /> <br />hereinafter <br /> <br />referred <br /> <br />to <br /> <br />as <br /> <br />"ENGINEER", for engineering services in connection with TCDP Contract <br />No. 707641, VICTORY GARDENS/DUNBAR IMPROVEMENTS in connection with the <br /> <br />reconstruction of Herndon, Knox and Reyes Streets with concrete Curb <br /> <br />and Gutter, 8" of Crushed Limestone Base, and 1 1/2" of Hot Mix Asphalt <br /> <br />Paving, including the installation of storm drain piping and inlets, <br /> <br />driveway repairs, <br /> <br />utility adjustments and the <br /> <br />installation of a 6 " <br /> <br />water main on Reyes Street and a sidewalk on Knox Street in accordance <br /> <br />with <br /> <br />the <br /> <br />design <br /> <br />parameters <br /> <br />utilized <br /> <br />in <br /> <br />the <br /> <br />preparation <br /> <br />of <br /> <br />the <br /> <br />Preliminary Construction Cost Estimate dated october 9, 1987 attached <br /> <br />hereto as Exhibit" A" . <br /> <br />WITNESSETH: <br /> <br />Owner and Engineer do hereby agree as follows: <br /> <br />AR~ICLE 1 <br /> <br />EHGIIŒER' S SERVICES ARD RESPORSIBILInES <br /> <br />Engineer <br /> <br />shall <br /> <br />be <br /> <br />responsible <br /> <br />for <br /> <br />the <br /> <br />proper, <br /> <br />accurate <br /> <br />and <br /> <br />adequate design of the TCDP Contract No. 707641, VICTORY GARDENS/DUNBAR <br /> <br />IMPROVEMENTS <br /> <br />PROJECT <br /> <br />as <br /> <br />well <br /> <br />as <br /> <br />the <br /> <br />preparation <br /> <br />of <br /> <br />accurate <br /> <br />and <br /> <br />adequate plans, specifications, reports and other construction contract <br /> <br />documents <br /> <br />for the project (s) , <br /> <br />and any provisions <br /> <br />in this Agreement <br /> <br />pertaining to Owner's review, approval and/or acceptance of reports, <br /> <br />plans, <br /> <br />specifications, <br /> <br />construction <br /> <br />contract <br /> <br />documents, <br /> <br />or <br /> <br />other <br /> <br />written materials prepared by Engineer or its consultants, contractors, <br /> <br />and subcontractors <br /> <br />in connection with this project(s) <br /> <br />shall not be <br /> <br />deemed to diminish Engineer's responsibility therefor. <br /> <br />The Engineer's <br /> <br />Basic Services consist of the following phases described in Paragraphs <br /> <br />1.1 through 1.6 and include normal structural, mechanical and <br /> <br />-1- <br />
