<br />81 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting August 27, 1984 Page 4 <br /> <br /> <br />unanimously for approval of the Ordinance on first reading and direct- <br />ed the public hearing be scheduled. <br /> <br />Mayor Craddock introduced for consideration a discussion of a land <br />use map change request for Stratford House Motel (0.699 acres out of <br />J. M. Veramendi Survey, No.2, located on IH35 Frontage Road at Uhlanc <br />Road). It was consensus of the Council this matter would be considered <br />under the new method of handling land use map changes after such time <br />as the Master Plan amendment Ordinance has been adopted by the Council <br />(first reading approved August 27, 1984). <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING ORDINANCE 1983-45,ADOPTED <br />SEPTEMBER 12, 1983, WHICH SET FORTH AN ITEMIZED ESTIM- <br />ATE OF THE EXPENSE OF CONDUCTING EACH ADMINISTRATIVE <br />UNIT OF THE MUNICIPAL GOVERNMENT OF SAID CITY FOR <br />THE FISCAL YEAR BEGINNING OCTOBER 1, 1983, AND END- <br />ING ON SEPTEMBER 30, 1984, AND APPROPRIATED MONEY <br />FOR THE VARIOUS FUNDS AND PURPOSES OF SUCH ESTI~ffiTE; <br />TO REVISE SAID ESTIMATES AND TO REAPPROPRIATE SAID <br />FUNDS; ADOPTING SAID REVISIONS AND ESTIMATES AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Ms. Kissler moved for approval of the Ordinance on second reading <br />and Mr. Brown seconded the motion, which passed unanimously (Mr. <br />Coddington was not present to vote on this item). <br /> <br />Mayor Craddock introduced for consideration a discussion by Jim <br />Nias of proposed changes for the Ethics Ordinance (the next item <br />of business on this agenda). Mr. Nias presented two changes, as <br />follows: SECTION 4. Sec. 2-73. Standards of conduct. (c) (1) "No <br />officer or employee shall be prohibited from representing his/her <br />own property interests before a board, agency, commission or depart- <br />ment...." and SECTION 6. Sec. 2-73. Standards of conduct. (e) "No <br />officer or employee shall be deprived of his/her right to due process <br />under the law which would include but not be limited to the right to <br />represent himself/herself in a court proceeding or in an administra- <br />tive or quasi-judicial proceeding which is a legally required prere- <br />quisite to the institution of a court proceeding, except as provided <br />Tn this ordinance." <br /> <br />Mayor Craddock introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 2-73 (b) (1) OF DIVI- <br />SION 1 OF ARTICLE V. CODE OF ETHICS OF CHAPTER 2 OF <br />THE CODE OF ORDINANCES OF THE CITY OF SAN MARCOS, TEXAS <br />TO DELETE THE PORTION OF SUCH SECTION WHICH PROHIBITS <br />CITY OFFICERS AND EMPLOYEES FROM REPRESENTING THEMSELVES <br />AND OTHERS BEFORE OTHER CITY DEPARTMENTS, AGENCIES, COM- <br />MISSIONS OR BOARDS; AMENDING SECTION 2-73(b) (3) OF SAID <br />DIVISION OF SAID ARTICLE OF SAID CHAPTER OF SAID CODE TO <br />DELETE THE PORTION OF SUCH SECTION WHICH PROHIBITS CITY <br />OFFICERS AND EMPLOYEES FROM REPRESENTING THEMSELVES AND <br />OTHERS IN MUNICIPAL COURT PROCEEDINGS INSTITUTED BY CITY <br />OFFICERS OR EMPLOYEES IN THE COURSE OF OFFICIAL DUTIES; <br />AMENDING SECTION 2-73 OF SAID DIVISION OF SAID ARTICLE <br />OF SAID CHAPTER OF SAID CODE TO DELETE SECTION 2-73(b) (5); <br />AMENDING SECTION 2-73 OF SAID DIVISION OF SAID ARTICLE OF <br />SAID CHAPTER OF SAID CODE TO ADD SUBSECTIONS (c), (c) (1) <br />AND (c) (2) TO ALLOW CITY OFFICERS AND EMPLOYEES TO REPRE- <br />SENT THEIR OWN INTERESTS IN OWNER-OCCUPIED HOMESTEADS BE- <br />FORE OTHER CITY BOARDS, AGENCIES, COMMISSIONS OR DEPART- <br />MENTS AND TO REPRESENT OTHERS BEFORE OTHER BOARDS, AGENCIES, <br />
