<br /> <br /> <br />0-- <br /> <br />.~ <br /> <br />G <br />0 <br /> <br />BE <br />TEXAS: <br /> <br />75 <br /> <br />ORDINANCE 1988-92 <br /> <br />AN ORnIN~NCE OF THE CITY COUNCIL nF THE CITY OF RAN <br />MARCOS, TEXAS, AMENDING ARTICLE II, ABANDONED PROPERTY, <br />OF CHAPTER 16 OF THE CODE OF ORDINANCES OF SAID CITY TO <br />RENUMBER THE EXISTING PROVISIONS OF ARTICLE II AS <br />DIVISION 1, ABANDONED PROPERTY OTHER THAN MOTOR VEHICLES; <br />TO ADD DIVISION 2, DEFINITIONS CONCERNING ABANDONED AND <br />JUNKED MOTOR VEHICLES, TO SAID ARTICLE, DEFINING TERMS; <br />TO ADD DIVISION 3, ABANDONED MOTOR VEHICLES, TO SAID <br />ARTICLE, PROHIBITING ABANDONMENT OF MOTOR VEHICLES, <br />AUTHORIZING IMPOUNDMENT, SETTING FORTH NOTICE <br />REQUIREMENTS AND OTHER PROVISIONS REGARDING PUBLIC <br />AUCTIONS, GARAGEKEEPERS IN POSSESSION, DISPOSAL TO <br />DEMOLISHERS AND DUTIES OF DEMOLISHERS; TO ADD DIVISION 4, <br />JUNKED VEHICLES, TO SAID ARTICLE DECLARING SAID VEHICLES <br />A PUBLIC NUISANCE, PROHIBITING JUNKED VEHICLES ON STREETS, <br />HIGHWAYS AND PRIVATE PROPERTY AND SETTING FORTH EXCEPTIONS, <br />PROVIDING FOR HARDSHIP APPEALS, SETTING FORTH PROCEDURES <br />AND NOTICE REQUIREMENTS FOR ABATING PUBLIC NUISANCES, <br />PROVIDING FOR DISPOSAL OF SUCH VEHICLES, AUTHORIZING <br />ENFORCEMENT ON PRIVATE PROPERTY, AND DECLARING THE <br />EFFECTIVE DATE OF SAID DIVISION 4; PROVIDING FOR <br />SEVERABILITY, RENUMBERING THE REMAINING SECTIONS OF SAID <br />CHAPTER; AND DECLARING AN EFFECTIVE DATE. <br /> <br />IT <br /> <br />ORDAINED <br /> <br />BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> <br />PART 1. That Article II, Abandoned Property, of Chapter 16 of <br />the Code of Ordinances of said City is hereby amended to renumber <br />the existing provisions as Division 1 of said Article II, to be <br />entitled Abandoned Property Other Than Motor Vehicles. <br /> <br />PART 2. That Division 2, Definitions Concerning Abandoned <br />and Junked Motor Vehicles, shall be added to Article II of Chapter <br />16 of the Code of Ordinances as follows: <br /> <br />ARTICLE II. ABANDONED PROPERTY <br /> <br />DIVISION 2. DEFINITIONS CONCERNING ABANDONED AND <br />JUNKED MOTOR VEHICLES <br /> <br />Sec. 16-33. <br /> <br />De fin i tions. <br /> <br />In Division 3 and 4 of this Article, the following words or <br />phrases shall have the meanings respectively ascribed to them: <br /> <br />(a) "Police department" means the police department of the <br />City of San Marcos, Texas, acting under the general police <br />power authority as vested in such department by its <br />respective governing body and State law. <br /> <br />(b) "Abandoned motor vehiclell means a motor vehicle that is <br />inoperable and more than eight years old and left <br />unattended on public property within the corporate limits <br />of the City of San Marcos, Texas for more than 48 hours, <br />or a motor vehicle that has remained illegally on public <br />property within the corporate limits of said City for a <br />period of more than 48 hours, or a motor vehicle that has <br />remained on private property within the corporate limits <br />of said City without the consent of the owner or person in <br />control of the property for more than 48 hours, or a motor <br />vehicle left unattended on the right-of-waY- of a <br />designated county, state, or federal highway within the <br />corporate limits of said City for more than 48 hours. <br /> <br />(c) "Demolisher" means a person whose business is to convert a <br />motor vehicle into processed scrap or scrap metal or to <br />otherwise wreck or dismantle a motor vehicle. <br /> <br />(d) "Garagekeeper" means an owner or operator of a parking <br />place or establishment, motor vehicle storage facility, or <br />place or establishment for the servicing, repair, or <br />maintenance of a motor vehicle. <br />
