0-- .~ G 0 BE TEXAS: 75 ORDINANCE 1988-92 AN ORnIN~NCE OF THE CITY COUNCIL nF THE CITY OF RAN MARCOS, TEXAS, AMENDING ARTICLE II, ABANDONED PROPERTY, OF CHAPTER 16 OF THE CODE OF ORDINANCES OF SAID CITY TO RENUMBER THE EXISTING PROVISIONS OF ARTICLE II AS DIVISION 1, ABANDONED PROPERTY OTHER THAN MOTOR VEHICLES; TO ADD DIVISION 2, DEFINITIONS CONCERNING ABANDONED AND JUNKED MOTOR VEHICLES, TO SAID ARTICLE, DEFINING TERMS; TO ADD DIVISION 3, ABANDONED MOTOR VEHICLES, TO SAID ARTICLE, PROHIBITING ABANDONMENT OF MOTOR VEHICLES, AUTHORIZING IMPOUNDMENT, SETTING FORTH NOTICE REQUIREMENTS AND OTHER PROVISIONS REGARDING PUBLIC AUCTIONS, GARAGEKEEPERS IN POSSESSION, DISPOSAL TO DEMOLISHERS AND DUTIES OF DEMOLISHERS; TO ADD DIVISION 4, JUNKED VEHICLES, TO SAID ARTICLE DECLARING SAID VEHICLES A PUBLIC NUISANCE, PROHIBITING JUNKED VEHICLES ON STREETS, HIGHWAYS AND PRIVATE PROPERTY AND SETTING FORTH EXCEPTIONS, PROVIDING FOR HARDSHIP APPEALS, SETTING FORTH PROCEDURES AND NOTICE REQUIREMENTS FOR ABATING PUBLIC NUISANCES, PROVIDING FOR DISPOSAL OF SUCH VEHICLES, AUTHORIZING ENFORCEMENT ON PRIVATE PROPERTY, AND DECLARING THE EFFECTIVE DATE OF SAID DIVISION 4; PROVIDING FOR SEVERABILITY, RENUMBERING THE REMAINING SECTIONS OF SAID CHAPTER; AND DECLARING AN EFFECTIVE DATE. IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, PART 1. That Article II, Abandoned Property, of Chapter 16 of the Code of Ordinances of said City is hereby amended to renumber the existing provisions as Division 1 of said Article II, to be entitled Abandoned Property Other Than Motor Vehicles. PART 2. That Division 2, Definitions Concerning Abandoned and Junked Motor Vehicles, shall be added to Article II of Chapter 16 of the Code of Ordinances as follows: ARTICLE II. ABANDONED PROPERTY DIVISION 2. DEFINITIONS CONCERNING ABANDONED AND JUNKED MOTOR VEHICLES Sec. 16-33. De fin i tions. In Division 3 and 4 of this Article, the following words or phrases shall have the meanings respectively ascribed to them: (a) "Police department" means the police department of the City of San Marcos, Texas, acting under the general police power authority as vested in such department by its respective governing body and State law. (b) "Abandoned motor vehiclell means a motor vehicle that is inoperable and more than eight years old and left unattended on public property within the corporate limits of the City of San Marcos, Texas for more than 48 hours, or a motor vehicle that has remained illegally on public property within the corporate limits of said City for a period of more than 48 hours, or a motor vehicle that has remained on private property within the corporate limits of said City without the consent of the owner or person in control of the property for more than 48 hours, or a motor vehicle left unattended on the right-of-waY- of a designated county, state, or federal highway within the corporate limits of said City for more than 48 hours. (c) "Demolisher" means a person whose business is to convert a motor vehicle into processed scrap or scrap metal or to otherwise wreck or dismantle a motor vehicle. (d) "Garagekeeper" means an owner or operator of a parking place or establishment, motor vehicle storage facility, or place or establishment for the servicing, repair, or maintenance of a motor vehicle.
