35 RESOLUTION 1987-l6R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AND ADOPTING PROCEDURES FOR ABANDONING STREETS, ALLEYS AND OTHER PUBLIC REAL PROPERTY (OTHER THAN PARKLAND) AND PORTIONS THEREOF, ESTABLISHING A FEE TO COVER ADMINISTRATIVE COSTS, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of San Marcos, Texas, on May 5, 1986, adopted policies for approving or denying requests for abandonments; and, WHEREAS, no formal procedures have been adopted for the abandonment of streets, alleys, or other public real property (other than parkland), or portions thereof: and, WHEREAS, there is a need for the adoption of procedures for said abandonments: and, WHEREAS, said abandonments require the expenditure of large amounts of time on behalf of the staff of said City; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. That the procedures set forth in Exhibit A, which is attached hereto and incorporated herein for all purposes, for the abandonment of streets, alleys or other public real property (other than parkland), or portions thereof, are hereby approved and adopted. PART 2. That a $300.00 fee plus $1.00 per linear foot for each foot over 350 feet requested to be abandoned, to cover administrative costs for processing abandonments, is hereby adopted and shall henceforth be paid for every requested abandonment. PART 3. That this Resolution shall be in full force and effect from and after its passage and shall apply to all abandonment requests not yet approved by the City Council.
