<br />35 <br /> <br />RESOLUTION 1987-l6R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS, APPROVING AND ADOPTING <br />PROCEDURES FOR ABANDONING STREETS, ALLEYS AND <br />OTHER PUBLIC REAL PROPERTY (OTHER THAN <br />PARKLAND) AND PORTIONS THEREOF, ESTABLISHING A <br />FEE TO COVER ADMINISTRATIVE COSTS, AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />WHEREAS, the City Council of the City of San Marcos, Texas, <br />on May 5, 1986, adopted policies for approving or denying requests <br />for abandonments; and, <br /> <br />WHEREAS, no formal procedures have been adopted for the <br />abandonment of streets, alleys, or other public real property <br />(other than parkland), or portions thereof: and, <br /> <br />WHEREAS, there is a need for the adoption of procedures for <br />said abandonments: and, <br /> <br />WHEREAS, said abandonments require the expenditure of large <br />amounts of time on behalf of the staff of said City; now, <br />therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. That the procedures set forth in Exhibit A, which <br />is attached hereto and incorporated herein for all purposes, for <br />the abandonment of streets, alleys or other public real property <br />(other than parkland), or portions thereof, are hereby approved <br />and adopted. <br /> <br />PART 2. That a $300.00 fee plus $1.00 per linear foot for <br />each foot over 350 feet requested to be abandoned, to cover <br />administrative costs for processing abandonments, is hereby <br />adopted and shall henceforth be paid for every requested <br />abandonment. <br /> <br />PART 3. That this Resolution shall be in full force and <br />effect from and after its passage and shall apply to all <br />abandonment requests not yet approved by the City Council. <br /> <br />ADOPTED this <br /> <br />9 <br /> <br /> <br />February <br /> <br />, 19 87 <br /> <br />,<~, <br />.E.
