<br />EXHIBIT A <br /> <br />PROCEDURES FOR ABANDONMENTS OF STREETS, <br />ALLEYS, OR OTHER PUBLIC REAL PROPERTY (OTHER THAN PARKLAND), <br />OR PORTIONS THEREOF <br /> <br />A. <br /> <br />All <br /> <br />requests <br /> <br />for abandonments of streets, <br /> <br />alleys, <br /> <br />or other <br /> <br />publ ic real property (other than parkland), <br /> <br />or portions thereof <br /> <br />shall be made in writing to the City Manager at San Marcos City <br /> <br />Hall, 630 East Hopkins, <br /> <br />San Marcos, <br /> <br />Texas 78666. <br /> <br />A request for <br /> <br />the abandonment of an alley or a portion of a street, <br /> <br />all <br /> <br />the <br /> <br />property of which is contiguous and not longer than 350 feet shall <br /> <br />constitute <br /> <br />one <br /> <br />abandonment <br /> <br />request. <br /> <br />Such written request shall <br /> <br />sufficiently <br /> <br />describe <br /> <br />(as <br /> <br />determined <br /> <br />by <br /> <br />City <br /> <br />staff) <br /> <br />the <br /> <br />area <br /> <br />requested <br /> <br />for <br /> <br />abandonment. <br /> <br />Requests <br /> <br />which do <br /> <br />not <br /> <br />sufficiently <br /> <br />describe the area requested to be abandoned will be returned to <br /> <br />the proponent(s). <br /> <br />B. <br /> <br />The City Manager shall <br /> <br />forward such written request to the <br /> <br />City Attorney. <br /> <br />Upon payment to the City of a $300.00 fee plus $1 <br /> <br />per <br /> <br />linear <br /> <br />foot <br /> <br />for <br /> <br />each <br /> <br />foot <br /> <br />over <br /> <br />350 <br /> <br />feet <br /> <br />to <br /> <br />cover <br /> <br />administrative costs of processing said request, the City Attorney <br /> <br />shall review said request for the purpose of determining whether <br /> <br />the <br /> <br />City has <br /> <br />an interest in the subject property which has not <br /> <br />been <br /> <br />previously <br /> <br />abandoned, <br /> <br />and <br /> <br />if <br /> <br />so, <br /> <br />shall <br /> <br />make <br /> <br />an <br /> <br />initial <br /> <br />determination in writing as to whether or not a survey will be <br /> <br />required to adequately describe the subject property for purposes <br /> <br />of conveying the same by deed following its abandonment. <br /> <br />1. <br /> <br />If the <br /> <br />City Attorney determines that the City has no <br /> <br />interest in the property which is subject to abandonment, he/she <br /> <br />shall so inform the proponent in writing. <br /> <br />-1- <br />
