<br />2. <br /> <br />If the <br /> <br />City Attorney determines <br /> <br />that the City has an <br /> <br />interest in the property which is the subject of the abandonment <br /> <br />request, <br /> <br />the <br /> <br />City <br /> <br />Attorney <br /> <br />shall <br /> <br />forward <br /> <br />such <br /> <br />request <br /> <br />to <br /> <br />the <br /> <br />Director of Public Works who shall, in writing, <br /> <br />request responses <br /> <br />in writing to such abandonment request from all appropriate City <br /> <br />staff and publ ic <br /> <br />utility <br /> <br />companies. <br /> <br />Upon <br /> <br />the <br /> <br />expiration <br /> <br />of <br /> <br />a <br /> <br />reasonable time <br /> <br />(not less than 21 calendar days) allowed by the <br /> <br />Director of Public Works for the submission by such public utility <br /> <br />companies and appropriate City staff of written responses to such <br /> <br />abandonment request, or upon the receipt by said Director of said <br /> <br />written responses, whichever is sooner, the Director shall forward <br /> <br />the file pertaining to such abandonment request to the Director of <br /> <br />Planning. <br /> <br />C. <br /> <br />The Director of Planning shall obtain cash in advance from <br /> <br />the <br /> <br />party requesting <br /> <br />the <br /> <br />abandonment, <br /> <br />to <br /> <br />cover <br /> <br />the <br /> <br />total <br /> <br />cost <br /> <br />estimated <br /> <br />by <br /> <br />a <br /> <br />qualified <br /> <br />appraiser <br /> <br />selected <br /> <br />by <br /> <br />the <br /> <br />City <br /> <br />for <br /> <br />his/her performance of an appraisal of the fair market value of <br /> <br />the subject property. <br /> <br />1. <br /> <br />Upon receipt by the City of said amount, the Director of <br /> <br />Planning <br /> <br />shall <br /> <br />cause <br /> <br />said <br /> <br />appraisal <br /> <br />to <br /> <br />be <br /> <br />performed <br /> <br />by <br /> <br />the <br /> <br />appraiser <br /> <br />and may, <br /> <br />at that time and <br /> <br />if the <br /> <br />proponent <br /> <br />desires, <br /> <br />collect from the proponent of the abandonment request <br /> <br />the <br /> <br />full <br /> <br />amount in cash of the appraised fair market value of the property. <br /> <br />2. <br /> <br />Further, <br /> <br />and, <br /> <br />if <br /> <br />desired <br /> <br />by <br /> <br />the <br /> <br />proponent <br /> <br />of <br /> <br />the <br /> <br />abandonment <br /> <br />request, <br /> <br />concurrently with <br /> <br />the <br /> <br />performance <br /> <br />of <br /> <br />said <br /> <br />appraisal, said Director of Planning shall submit the <br /> <br />abandonment <br /> <br />-2- <br />
