<br />capacity according to the schedule of build-out it currently <br />proj ects, but acknowledges that the District 's capacity <br />requirements may change. The City agrees to make any such <br />required capaci ty available, and the District agrees to <br />compensate the City therefor in accordance with this Agree- <br />ment. If at any time the capacity required by the District <br />is not available from the City, the City will provide <br />temporary or alternative sources of utility service, or the <br />City will agree to construction by the District of a portion <br />of the Regional Facilities such that service to the District <br />is not di srupted. <br /> <br />Section 3.11. Water Usage and Measurement. At the <br />times requested by the District, the City agrees to sell and <br />deliver to the District all water which may reasonably be <br />required for domestic and commercial purposes by users <br />within the District. Metering equipment and related facil- <br />ities, including standard-type devices required for properly <br />measuring the quantity of water delivered to a retai 1 <br />customer shall be installed at each customer's delivery <br />point according to then current City policies and charges. <br />The City shall not establish procedures which differentiate <br />charges or practices between in-City and out-of-City custom- <br />ers. Nothing herein shall preclude the District from <br />charging tap fees. If at any time the said City policy and <br />this Agreement conflict, this Agreement shall control. The <br />City, at its expense, shall operate and maintain the meter- <br />ing equipment and related facilities and shall calibrate the <br />metering equipment. <br /> <br />Section 3.12. Water and Wastewater Rates and Billing. <br />The City shall bill and collect water and wastewater charges <br />from customers in the District according to the same pol- <br />icies and on the same basi s as its custOr:lers wi thin its <br />corporate limits. The City shall not establish procedures <br />which differentiate charges or practices between in-City and <br />out-of-City customers. Rates charged to customers within <br />the District for water supply and wastewater collection and <br />treatment service and for billing and collection services <br />shall be set by the District at the same rate the City <br />charges its retail in-City customers. From time to time a <br />maintenance tax and/or administrative fee may be levied by <br />the District on customers within the District and the City <br />agrees to collect same and deliver such revenues to the <br />District. Invoices to customers in the District shall be <br />sent by the City, and each customer inside the Di strict <br />shall pay the City. The City agrees that its records on <br /> <br />-11- <br />
