<br />customers within the District shall be open to inspection by <br />the District's audi tors. <br /> <br />Section 3.13. Water Conservation. LRL agrges to adopt <br />water conservation measures as described in Exhibit !IF" <br />hereto. <br /> <br />Section 3.14. Certificate of Convenience and Necessi- <br />!y. The District agrees to use its best efforts to secure a <br />Certificate of Convenience and Necessity from the Commission <br />to clarify the boundaries of the District's service area. <br />Should the District fail to secure such certificate, the <br />City is not relieved of its obligations under this Agree- <br />ment. <br /> <br />ARTICLE FOUR <br /> <br />PARK FACILITIES, SOLID WASTE COLLECTION <br />AND DISPOSAL, AND FIRE PROTECTION SERVICE <br /> <br />Section 4.01. Park and Recreation Faci Ii ties. The <br />Ci ty agrees that the District may develop, operate and <br />maintain public parks and recreational facilities in accor- <br />dance with Section 54.771 through 54.775, Texas Water Code. <br />The parties agree that the District may own the public <br />parkland established pursuant to the City's Subdivision <br />Ordinance and any improvements constructed thereon by LRL or <br />by the District until such time as the Ci ty desires to <br />assume ownership and operation and maintenance responsibil- <br />ity. The District is not required to operate and maintain <br />any parkland or park or recreational facilities thereon that <br />it does not own. Nothing herein shall be deemed to preclude <br />establishment of additional recreational areas and improve- <br />ments outside the terms of this Agreement. <br /> <br />Section 4.02. Solid Waste Collection Service. The <br />District and the City agree that the City will provide solid <br />waste collection and disposal services for the District <br />through the City's existing regional solid waste collection <br />and disposal program. The District may establish a fee for <br />such service equal to the City's basic fee established by <br />ordinance in effect on the effective date of this Agreement <br />for the City's solid waste collection and disposal system. <br />The fee shall include a surcharge of 17% payable to the City <br />which shall be restricted to use by the City for solid waste <br />collection and/or disposal efforts if LRL does not convey a <br />site restricted for solid waste transfer purposes to the <br /> <br />-12- <br />
