<br />74 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />Regular Meeting October 22, 1984 Page 6 <br /> <br /> <br />Mayor Craddock introduced for consideration adoption of a Resolu- <br />tion, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING AND APPROVING THE TERMS <br />AND CONDITIONS OF A COMPLIANCE AGREEMENT BETWEEN <br />SAID CITY AND THE EXECUTIVE DIRECTOR OF THE TEXAS <br />DEPARTMENT OF WATER RESOURCES WITH REGARD TO THE <br />WITHHOLDING OF ENFORCEMENT ACTION BY TDWR AGAINST <br />SAID CITY FOR ALLEGED VIOLATIONS OF THE TEXAS SOLID <br />WASTE DISPOSAL ACT (TEX.REV.CIV.STAT.ANN., ART. 4477-7) <br />AND/OR CHAPTER 26 OF THE TEXAS WATER CODE IF SAID CITY <br />COMPLIES WITH THE TERMS OF SUCH AGREEMENT; AUTHORIZING <br />THE CITY MANAGER TO EXECUTE SAID COMPLIANCE AGREEMENT <br />ON BEHALF OF SAID CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock moved for adoption of the Resolution and Mr. Guerra <br />seconded the motion. Mr. Hankins pointed out some minor changes <br />that had been made to the agreement. AND SAID <br />CITY OF MAY 16, 1984 FOR THE PROVISION OF ENGINEERING <br />SERVICES TO SAID CITY IN CONNECTION WITH THE CONSTRUC- <br />TION OF FIVE (5) PACKAGE WASTEWATER TREATMENT PLANTS <br />FOR SAID CITY TO PROVIDE INTERIM TREATMENT CAPACITY <br />UNTIL EXPANSION OF THE CONTACT STABILIZATION PLANT <br />(PLANT NO.2) IS COMPLETE; AUTHORIZING THE CITY MAN- <br />AGER OF SAID CITY TO EXECUTE SAID ADDENDUM ON BEHALF <br />OF SAID CITY AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Craddock moved for adoption of the Resolution and Mr. Farr second- <br />ed the motion. Mr. Coddington questioned why the engineering on five <br />plants. Mr. Gonzalez stated it would be a simple procedure for them <br />to proceed with the last two now that they had completed the design <br />for three. Mr. Gonzalez stated the price had been negotiated and the <br />price in the amendment represents a maximum total but that the City <br />would only be charged by the hour. Mr. Coddington asked Mr. Gonzalez <br />for a review of all Freese and Nichols' charges. On roll call the <br />following vote was recorded: <br /> <br />AYE: Brown, Farr, Craddock, Guerra, Kissler. <br /> <br />NAY: Coddington, Moore. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Craddock introduced for consideration adoption of a Resolution, <br />the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXE- <br />CUTE ON BEHALF OF SAID CITY CONTRACTS FOR WHICH BIDS <br />HAVE BEEN PREVIOUSLY AWARDED BY THE CITY COUNCIL AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerra moved for adoption of the Resolution and Ms. Kissler seconded <br />the motion, which passed unanimously. <br />
