(b) section lOl.4-PLUMBING DEPARTMENT is deleted. (c) new section 101.4 is added to read as follows: Section 101.4 Plumbing Official. There is hereby established a plumbing official who shall be the Chief Building Official in the Building Inspections Department. (d) section 103.1 is added to read as follows: Section 103.1 Licensing and bonding of persons installing plumbing. (a) all persons performing plumbing work or contracting to perform plumbing work shall be master plumbers licensed as required by the Texas Plumbing License Law of 1947. (b) a person who desires a permit for plumbing work shall furnish a bond in the amount of $5000 to protect the City from liability that might accrue .because of injury to the public to guarantee compliance with City codes and regulations and to protect City property from his or her work. (c) a homeowner may install or maintain plumbing on his or her own residential homestead property without a license, but he or she must obtain a permit, pay fees and act in compliance with all other provisions of this code except as provided in Al03.l.3. (d) Section 105 is 105.1 as follows: amended by the addition of Section Section 105.1 Clarification. All references in this Code to the Board of Adjustments shall be construed as a reference to the the Plumbing Board of Adjustments and Appeals. (e) Section 107 is added to read as follows: Section 107 Liability. This Code shall not be construed so as to relieve or lessen the liability of any corporation, partnership, association, individual, or agent performing any plumbing work. Nor shall the City of San Marcos be held as assuming any liability by reasons of inspections, certifications, licensure or permit issuance done pursuant to the provisions of this Code. SECTION 3. That this Ordinance shall be in effect ten (10) days from and after its passage, and it shall be published in a newspaper of general circulation in the area as required by the Charter of the City of San Marcos, Texas.
