<br />89 <br />Regular Meeting November 5, 1984 Page 2 <br />Mayor Craddock introduced for consideration an Ordinance on emergen- <br />cy, amending Section 1 of Ordinance 1984-70 adopted June 13, 1984 <br />declaring a building moratorium to delete therefrom Planning Units <br />18 and 32, renumbering Sections 2 through 5 of said Ordinance, adding <br />a new Section 2 to provide that subdivision plats, zoning changes and <br />building permits for new development shall not be approved in Plannins <br />Units 18 and 32 unless a prior determination is made by the Director <br />of Public Works and the Director of Environment and Engineering that <br />such development will not adversely impact water, wastewater, drain- <br />age and street deficiencies; declaring an emergency and providing for <br />an effective date. Due to the decision by the Council that amendments <br />were needed to the Ordinance, the caption was not read into the record, <br />and Mayor Craddock moved the Ordinance be tabled until November 19, <br />1984 and Mr. Coddington seconded the motion, which passed unanimously. <br />Mayor Craddock introduced a report from the Citizens Advisory Committee <br />and the Staff regarding the San Marcos River Ecosystem. Mr. Robbins <br />stated the City needs to develop standards for this area (all land <br />area within the One Hundred Year Flood Plain of the San Marcos River <br />from Spring Lake to the confluence of the Blanco and San Marcos Rivers) <br />and that the following Ordinance would encompass the area of particular <br />concern. Mr. Farr expressed concern for the State's construction ad- <br />versely impacting the River and wanted to know if the City could regu- <br />late the contractors working for the State. Mr. Hankins advised it <br />would be difficult to do and that the contractors could be exempt if <br />they were only working in our City for the State. Mr. Jenkins stated <br />the Corps of Engineers would be looking at the Sessom Creek area and <br />making a determination whether or not the State's fill was in the <br />River. Mr. Gonzalez stated the State is responding but not early <br />enough in the process and that dialogue needs to be encouraged more. <br />Mr. Hankins stated the Council could ask the Corps of Engineers to <br />take jurisdiction, or the City could sue the Corps of Engineers for <br />not taking jurisdiction, or the City could join with another entity <br />to sue the Corps of Engineers for not taking jurisdiction, or could <br />work with the Legislature for environmental legislation. Mr. Jenkins <br />said adverse impact also needed to be defined in this Ordinance.
