<br />29 <br /> <br />LEASE AGREEMENT <br /> <br />This Lease Agreement (hereinafter referred to as the "Agreement") <br /> <br />made the 1st day of February , <br /> <br />1987, <br /> <br />by and between the City of San <br /> <br />Marcos, <br /> <br />Texas, <br /> <br />(hereinafter <br /> <br />referred <br /> <br />to <br /> <br />as <br /> <br />"Lessor" ) <br /> <br />a <br /> <br />municipal <br /> <br />corporation existing by and under the laws of the State of Texas, acting <br /> <br />through authori ty conferred on its Mayor, J. E. <br /> <br />Younger, by resolution <br /> <br />duly <br /> <br />adopted <br /> <br />on <br /> <br />March 9 <br /> <br />, <br /> <br />1987, <br /> <br />and <br /> <br />the <br /> <br />Confederate <br /> <br />Air <br /> <br />Force <br /> <br />(hereinafter referred to as "Lessee"). <br /> <br />The parties hereto have severally <br /> <br />and collectively agreed and by the execution hereof are bound to the <br />mutual obligations hereinafter described: <br /> <br />WITNESSETH: <br /> <br />That Lessor in consideration of the covenants hereinafter contained <br /> <br />on the part of the Lessee to be paid, kept and performed, has demised and <br />let, and by these presents does demise and let unto Lessee, that certain <br /> <br />real <br /> <br />and personal property located at San Marcos Municipal Airport, <br /> <br />Caldwell County, Texas, and described as follows: <br /> <br />Leased Premises: <br /> <br />Leased <br /> <br />Building, <br /> <br />identified <br /> <br />and <br /> <br />shown <br /> <br />on <br /> <br />Exhibit <br /> <br />A <br /> <br />hereto <br /> <br />(hereinafter referred to as lithe Premises") <br /> <br />together with the right of <br /> <br />ingress and egress using roads, streets, and taxiways in accordance with <br /> <br />the <br /> <br />San <br /> <br />Marcos <br /> <br />Municipal <br /> <br />Airport <br /> <br />Standard <br /> <br />Operatinq <br /> <br />Procedures and <br /> <br />Requlations and in such a manner as to not interfere with the <br /> <br />rights <br /> <br />of <br /> <br />others using said roads, streets and taxiways; and <br /> <br />Six (6) contiguous concrete tie-down spaces for the exclusive use of <br /> <br />Confederate <br /> <br />Air <br /> <br />Force <br /> <br />airplanes. <br /> <br />These <br /> <br />tie-down <br /> <br />spaces <br /> <br />will <br /> <br />be <br /> <br />designated by the Airport Manager. <br /> <br />To have and hold the above-described premises for an initial term of <br /> <br />five <br /> <br />(5) <br /> <br />years, <br /> <br />beginning <br /> <br />on <br /> <br />the <br /> <br />1st <br /> <br />day <br /> <br />of <br /> <br />February, <br /> <br />1987, <br /> <br />and <br /> <br />terminating on the 1st day of February, <br /> <br />1992, <br /> <br />subj ect to the further <br /> <br />provisions hereof. <br />This Lease is made upon the following covenants and conditions: <br /> <br />1. <br /> <br />The Lease fee fdr the Premises is $2,400.00 per year for the <br /> <br />duration of the initial term of the Lease. <br /> <br />The consideration for this <br /> <br />Lease is the agreement by Lessee to make payment of $200.00 per month or <br />to provide serivces to the San Marcos Municipal Airport with a reasonable <br /> <br />value of labor, equipment, and materials in such <br /> <br />service <br /> <br />equivalent <br /> <br />to <br /> <br />-1- <br />
