33 THE STATE OF TEXAS COUNTY OF HAYS A.9.&KKMKNI THIS AGREEMENT by and between, S&S LAND AND CATTLE COMPANY, herein referred to as S&S; SAN MARCOS 186 LIMITED PARTNERSHIP, herein referred to as SAN MARCOS 186; ALEXANDER, ET AL, herein referred to as ALEXANDER GROUP; and the CITY OF SAN MARCOS, herein referred to as CITY, in connection with the con- struction of an approximately 4300 linear foot sanitary sewer line from the existing manhole approximately 1000 ft. NE of Wonder World Drive in the City of San Marcos, Texas, along the line of Willow Creek as currently relocated to the NW side of Hunter Road, as follows: WHEREAS, S&S is the owner of approximately 429 acres of land, more or less. being more particularly described on Exhibit A attached hereto and incorporated by reference herein; and WHEREAS. SAN MARCOS 186 is the owner of approximately 179 acres of land, more or less, known locally as Hunter Hills Subdivision, and being more particularly described on Exhibit B attached hereto and incorporated by reference herein; and 67 acres Drive and Exhibit C and WHEREAS. ALEXANDER GROUP is the owner of approximately of land, more or less, located between Wonder World Hunter Road, and being more particularly described on attached hereto and incorporated by reference herein; WHEREAS, CITY is desirous of extending the sewer line from the existing manhole approximately 1000 ft. NE of Wonder World Drive along the line of Willow Creek as relocated over the ALEXANDER GROUP 67 acre tract and the adjoining KROGER Property tract to a manhole to be located on the SAN MARCOS 186 tract on the NW side of Hunter Road; and WHEREAS, S&S. SAN MARCOS 186 and ALEXANDER GROUP are desirous of obtaining the extension of sewer service from said existing manhole approximately 1000 ft. NE of Wonder World Drive along the line of Willow Creek as relocated over the ALEXANDER GROUP 67 acre tract and the adjoining KROGER Property tract to a manhole to be located on the NW side of Hunter Road for the pur- pose of obtaining sewer service for the ALEXANDER GROUP 67 acre tract, the adjoining KROGER tract, the SAN }lARCOS 186 179 acre tract, and the S&S 429 acre tract; NOW. THEREFORE, the parties hereto agree as follows: 1. That ProTech Engineering will be employed for the purpose of completing the engineering, design. plans, specifica- tions and supervising the bidding and construction of an 18" sewer line from said manhole to the respective properties; 2. That SAN MARCOS 186 and S&S will share equally in the actual cost of the services of ProTech Engineering for such completion of engineering. design. plans. specifications and su- pervising the bidding and construction of said 18" sewer line. but not to exceed the amount of $16.000.00; 3. That upon the completion and approval of the engineering. design, plans. and specifications for the construc- tion of said 18" sewer line. CITY will contract for and pay the actual construction expense for the construction of the approx. 4300 linear foot 18" sewer line beginning at said existing man- hole located approximately 1000 feet NE of Wonder Wonder World Drive and continuing along Willow Creek to the southwest side of Wonder World Drive on the ALEXANDER GROUP 67 acre tract and con- tinuing along Willow Creek as relocated on the ALEXANDER GROUP 67 acre tract and the KROGER tract, and under Hunter Road
