<br />(4) limit. modify, or abridge the authority of the Governor to proclaim <br />martial law or exercise any other powers vested in him under the constitution or <br />laws of this state independent of or in conjunction with any provisions of this <br />Act. <br /> <br />Defi nit ions <br /> <br />Section 4. In this Act <br />[ (1) ""Disaster" means the occurrence or imminent threat ùf \";::<:spread 0"- <br />severe damage, injury, or loss of life or property resulting froll! any natura1 or <br />man-made cause, including fire, flood, earthquake, wind, storm, wave action, oil <br />spill or other water contamination, volcanic activity, epidemic, air con- <br />tamination, blight, drought, infestation, explosion, riot, hostile military or <br />paramilitary action, other public calamity requiring emergency action, or energy <br />emergency. <br />(2) "Political subdivisionll means a county or incorporated city. <br />(3) "Organized volunteer groups" means organizations such as the American <br />National Red Cross, the Salvation Army, Civil Air Patrol, Radio Amateur Civil <br />Emergency Services, and other similar organizations recognized by fed~ra1 or <br />state statute, regulation, or memorandum. <br />(4) "Temporary housing" means temporary housing as defined in the Federal <br />Disaster Relief Act of 1974 (PL 93-288,88 Stat., 143).1 <br />[ (5) "Interjurisdictional agency" means a disaster agency maintained by and <br />serving more than one political subdivision. <br />[ (6) IIEnergy emergency" means a temporary statewide, regional, or local <br />shortage of petroleum or liquid fuels energy supplies that makes emergency <br />measures necessary to reduce demand or allocate supply. <br /> <br />142 U.S.C.A. §§ 5121 et seq., 5174. <br /> <br />[ <br /> <br />The Governor and Emergency Management <br /> <br />Section 5.[ (a) The Governor is responsible for meeting the dangers to the <br />state and people presented by disasters and disruptions to the state and people <br />caused by energy emergencies. <br />(b) Under this Act, the Governor may issue executive orders, proclama- <br />tions, and regulations and amend or rescind them. Executive orders, proclama- <br />tions, and regulations have the force and effect of law. <br />[ (c) The Governor may establish by executive order an Emergency Management <br />Council to advise and assist him in all matters relating to disaster prepared- <br />ness, emergency servi ces, energy emergenci es, and di saster recovery. The <br />Emergency Management Counci 1 is composed of the heads of state agenci es, boards, <br />and commissions and representatives of organized volunteer groups. <br />[ (d) A state of disaster may be declared by executive order or proclamation <br />of the Governor if he finds a disaster has occurred or that the occurrence or <br />the threat of disaster is imminent. The state of disaster continues until the <br />Governor finds that the threat or danger has passed or the disaster has been <br />dealt with to the extent that emergency conditions no longer exist and ter- <br />mi nates the state of di saster by executive order, but no state of di saster may <br />continue for longer than 30 days unless renewed by the Governor. The legisla- <br />ture by law may terminate a state of disaster at any time. On termination by <br />the legislature, the Governor shall issue an executive order ending the state of <br />disaster.
