<br />shall indicate the nature of the disaster, the area threatened, and the con- <br />ditions which have brought it about or which make possible termination of the <br />state of disaster. An executive order or proclamation shall be disseminated <br />promptly by means calculated to bring its contents to the attention of the <br />general public and, unless the circumstances attendant on the disaster prevent <br />or impede, promptly filed with the Division of Emergency Management, the secre- <br />tary of state, and the county clerk or city secretary in the area or areas to <br />which it applies. <br />[ (e) An executive order or proclamation setting forth a state of disaster <br />act-ivate:.; the disaster recovery and rehabilitation aspects of the state <br />emeigei1cy liianagement plan applicable to the area in question and is author'ity <br />for the deployment and use of any forces to which the plan applies and for use <br />or distribution of any supplies, equipment, and materials and facilities <br />assembled, stockpiled, or arranged to be made available pursuant to this Act or <br />any other provision of law relating to disasters. The preparedness and response <br />aspects of the plan shall be activated as provided in the plan. <br />[ (f) Duri ng the conti nuance of any state of di saster and the pursuant re- <br />covery period, the Governor is Commander-in-Chief of state agencies, boards, and <br />commissions having emergency responsibilities. To the greatest extent prac- <br />ticable, the Governor shall delegate or assign command authority by prior <br />arrangement embodied in appropriate executive orders or plans, but nothing in <br />this Act restricts his authority to do so by orders issued at the time of the <br />disaster. <br />(g) <br />may: <br />[ (1) suspend the provisions of any regulatory statute prescribing the pro- <br />cedures for conduct of state business or the orders, rules, or regulations of <br />any state agency if strict compliance with the provisions of any statute, order, <br />rule, or regulation would in any way prevent, hinder, or delay necessary action <br />in coping with the disaster; <br />[ (2) ut il i ze all avail ab 1 e resources of the state government and of each <br />political subdivision of the state which are reasonably necessary to cope with <br />the disaster; <br />[ (3) temporari ly reassi gn resources, personnel, or functions of state execu- <br />tive departments and agencies or their units for the purpose of performing or <br />facilitating emergency services; <br />[ (4) subject. to any appl icable requi rements for compensation under Section <br />12 of this Act, commandeer or utilize any private property if he finds this <br />necessary to cope with the disaster; <br />(5) recommend the evacuation of all or part of the population from any <br />stricken or threatened area in the state if he deems this action necessary for <br />the preservation of life or other disaster mitigation, response, or recovery; <br />(6) prescribe routes, modes of transportation, and destinations in connec- <br />tion with evacuation; <br />(7) control ingress and egress to and from a disaster area and the move- <br />ment of persons and the occupancy of premises in the area; <br />(8) suspend or limit the sale, dispensing, or transportation of alcoholic <br />beverages, firearms, explosives, and combustibles; <br />(9) enter into purchase, lease, or other arrangements with an agency of <br />the United States for temporary housing units to be occupied by disaster victims <br />and to make units available to any political subdivision of the state; <br />(10) assist any political subdivision which is the locus of temporary <br />housi ng for di saster vi ct ims to acqui re sites necessary for temporary housi ng <br />and to do all things required to prepare the site to receive and utilize tem- <br />porary housing units by. advancing or lending funds available to the Governor <br /> <br />In addition to any other ~owers conferred on the Governor by law, he <br /> <br />Attachment 2 <br />Tab 1 <br />Page 3 <br />
