<br />APPENDIX 4 <br /> <br />STAFFING PLAN <br /> <br />4.1 Staffing Plan <br /> <br />The Authority shall provide a staff of qualified and experienced employees in accordance with <br />this Service Contract, Applicable Law and this Staffing Plan, and shall provide such additional third-party <br />support as may be needed to perform its duties and obligations hereunder. Such third-parties shall be <br />equally qualified for the particular services to be performed and shall not have any direct claim against <br />the City whatsoever. The Authority shall maintain the necessary number of employees, staff and <br />third-party contractors to operate, maintain and manage the Water Treatment Facilities in accordance with <br />the Service Contract; to adequately maintain the Water Treatment Facilities in good repair; to adequately <br />operate the Water Treatment Facilities to enable the City to provide good service to its customers; and to <br />protect the health, safety and welfare of the citizens of the City. The Authority shall provide full-time (24 <br />hour per day, 7 day per week) staffing at the Plant. <br /> <br />The Authority shall submit a Staffing Plan to the City for approval no later than l5 days prior to <br />the Commencement Date. The Staffing Plan shall include, at a minimum, the following information: <br /> <br />· Requirement that the Water Treatment Facilities staff consist of: <br /> <br />- five full-time operators, <br />- Jerry Sharp as full-time Facilities Manager, and <br />- availability of Darel Ball and/or other Senior Supervisors for general oversight, <br />supervision and guidance; <br /> <br />· Requirement that all operators working at the Water Treatment Facilities are qualified <br />licensed operators in compliance with TCEQ requirements; <br /> <br />· Requirement that the Authority shall make available to the Water Treatment Facilities as <br />needed technical support from other Authority operations or third-party contractors; <br /> <br />· Requirement that the Authority shall comply with Applicable Law, including all <br />additional licenses and qualifications necessary to satisfy regulatory requirements; <br /> <br />· Requirement that the Authority's coverage at the Water Treatment Facilities and the staff <br />proposed for laboratory, operations and maintenance is in conformance with the <br />Authority's March 2005 proposal, its clarifications and this Service Contract; and <br /> <br />· Requirement that the positions, titles and responsibilities of each Authority employee, are <br />in conformance with the attached organization chart. <br /> <br />The Authority shall have the ability to revise the Staffing Plan provided that the Authority <br />receives written approval of the revised Staffing Plan from the City. <br /> <br />4.2 Training <br /> <br />The Authority shall be responsible for training to all of its employees of the Water Treatment <br />Facilities.
