<br />City of San Marcos/Guadalupe-Blanco River Authority <br />Water Treatment Facilities <br /> <br />Service Contract <br />Article VI - Management and Operation <br /> <br />(8) a description of any regulatory or insurance inspections conducted <br />during the prior month, the anticipated results, and activities performed to comply with <br />such inspections; <br />(9) information on any Utility outages occurring during the prior month; <br />(10) any failure to meet permit standards; <br />(11) a description of any environmental, health or safety tests or monitoring <br />procedures conducted by any Govemmental Body, during the prior month, and copies <br />of any reports or other submittals made to or received from any such Govemmental <br />Body; and <br />(12) any notices of violations of any Govemmental Approval received during <br />the prior month. <br />(B) Annual Operations and Maintenance Reports. The Authority shall <br />fumish the City, within 60 days after the end of each Contract Year, an annual summary of the <br />information contained in the monthly operations reports. That report will also include a list of <br />any Facilities Equipment disposed of as surplus property during the year pursuant to Section <br />8.6; and the quantity of electricity used during the year. The Authority shall also perform and <br />report to the City, as part of its annual operations report, the results of an annual review of <br />administrative, operational and maintenance practices employed in the management of the <br />Facilities. Such report shall include summaries of Service Fee payments and any necessary <br />reconciliations. <br /> <br />(C) Default Reports. The Authority shall provide to the City, immediately <br />after the receipt thereof, copies of any written notice of a material default, breach or <br />non-compliance received or sent under or in connection with any material contract entered into <br />by the Authority in connection with the Contract Services. <br />(D) Permit Communications and Reports. The Authority shall provide to the <br />City copies of all communications and reports fumished to any Govemmental Body pursuant <br />to this Section simultaneously with their submittal to the Govemmental Body. <br />SECTION 6.16. EMERGENCIES. Should the Authority fail, refuse or be <br />unable to operate the Facilities in accordance with the Service Contract for a period of 24 <br />hours, the City may provide the Authority with written notice of such failure, refusal or <br />inability. If the Authority fails, refuses or is unable to resume operation of the Facilities in <br />accordance with the Service Contract within 24 hours of receipt of notice from the City, then <br />the City may (but shall not be obligated to) take possession of the Facilities and perform the <br />Authority's operations obligations. If the Authority fails, refuses or is unable to operate the <br />Facilities in accordance with the Service Contract for any period of time, and such failure, <br />refusal or inability to operate the Facilities would, in the opinion of the City, endanger public <br />health, safety or welfare, the City, upon written notice, may (but shall not be obligated to) take <br /> <br />47 <br />
