<br />City of San Marcos/Guadalupe-Blanco River Authority <br />Water Treatment Facilities <br /> <br />Service Contract <br />Article VI - Management and Operation <br /> <br />a format consistent with similar reports the Authority prepares for other operations and an <br />annual income statement prepared in accordance with generally accepted accounting <br />principles showing profit or loss under this Service Contract. The annual statement may be <br />based upon the Authority's fiscal year. <br />(E) Inspection. Audit and Ad;ustment. The City shall have the right to <br />perform or commission an inspection or an independent audit of the fmancial information <br />required to be kept under this Section, subject to possible reimbursement as provided in this <br />Section. The inspection or audit of any fmancial information shall be conducted no later than <br />three years following the year in which fmancial transactions were incurred that are the <br />subject of the financial information. If an inspection or audit reveals that the City has overpaid <br />the Service Fee, then the Authority shall, at the election of the City, either immediately <br />reimburse to the City or offset against future Service Fee payments, as a Service Fee <br />adjustment, the overpaid amount. If an inspection or audit reveals that the City has underpaid <br />the Service Fee, then the City shall immediately pay the underpaid amount. The foregoing <br />remedies shall be in addition to any other remedies the City may have, including remedies for <br />an Event of Default by the Authority. <br />SECTION 6.15. PERIODIC REPORTS. (A) Monthlv Operations. The Authority <br />shall provide the City with monthly operations reports no later than 15 days after the end of <br />each calendar month, including the following operating data: <br />(1) a summary of all notices and laboratory, test and other reports filed with <br />or received from all Govemmental Bodies pursuant to the Govemmental Approvals; <br />(2) a summary of the quantities and characteristics of Finished Water <br />received and distributed, and the quantity of Unaccounted-For Water produced during <br />such month; <br />(3) a summary of quantities and types of chemicals and other agents used in <br />the treatment of Finished Water; <br />(4) a summary of operational issues, including personnel and Utility usage; <br />(5) a description of any complaints received by the Authority in relation to <br />the Contract Services and of how each complaint was addressed by the Authority; <br />(6) a brief description of the maintenance, repair and replacement activities <br />performed and Capital Modifications made by the Authority during the prior month and <br />anticipated during the current month; <br />(7) any adverse conditions which may reasonably be expected to arise <br />during the current month that may affect the ability of the Authority to collect, receive, <br />and treat Well Water and to distribute Finished Water in accordance herewith; <br /> <br />46 <br />
