It was consensus of Council the customer should not be charged and that refund should be made to the other customers who had paid under similar circumstances and that amendment be made to the Ordinance to address this concern. Mr. Guerra moved to table the next discussion on the agenda (discus- sion and direction to Staff regarding a tentative agreement on the jurisdictional boundaries of the Cities of San Marcos and Kyle) until after Executive Session and Mr. Coddington seconded the motion, which passed unanimously. Mr. Nicola moved to adjourn into Executive Session pursuant to Article 6252-17, §§2(e), (f) and (g), V.A.C.S., to discuss contem:olated liti- gation, matters where the duties of the City Attorney to the City pur- suant to the Code of Professional Responsibility of the State Bar of Texas clearly conflicts with Article 6252-17; exchange and value of real property; and evaluation of a public officer or employee, respective- ly and l1s. Kissler seconded the motion, which passed una~imously (10:20 p.m.). Mr. Farr moved the Council reconvene at 11:24 p.m. and Ms. Kissler se- conded the motion, which passed unanimously. Mr. Farr moved to remove Item 17C from the table and Ms. Kissler seconded the motion, which passed unanimously. Mr. Guerra introduced a discussion and direction to Staff regarding a tenative agreement on the jurisdictional boundaries of the Cities of San Marcos and Kyle (Item 17C). The Council directed Staff to set up a schedule for no more than three Council Members at a time to go on-site of the property in question. Ronnie Cantrell advised the Council he would be willing to clarify any property values if they so desired. Mr. Brown moved the Council adjourn into Executive Session pursuant to Article 6252-17, §2(f), V.A.C.S., to discuss the exchange and value of real property, and Mr. Guerra seconded the motion, which passed unanimously (11:30 p.m.). Mr. Farr moved the Council reconvene at 11:40 p.m. and Ms. Kissler seconded the motion, which passed unanimously.
