The discussion pertained to persons living within the <br />city limits only. It was consensus of Council the customer should <br />not be charged and that refund should be made to the other customers <br />who had paid under similar circumstances and that amendment be made <br />to the Ordinance to address this concern. <br /> <br />Mr. Guerra moved to table the next discussion on the agenda (discus- <br />sion and direction to Staff regarding a tentative agreement on the <br />jurisdictional boundaries of the Cities of San Marcos and Kyle) until <br />after Executive Session and Mr. Coddington seconded the motion, which <br />passed unanimously. <br /> <br />Mr. Nicola moved to adjourn into Executive Session pursuant to Article <br />6252-17, §§2(e), (f) and (g), V.A.C.S., to discuss contem:olated liti- <br />gation, matters where the duties of the City Attorney to the City pur- <br />suant to the Code of Professional Responsibility of the State Bar of <br />Texas clearly conflicts with Article 6252-17; exchange and value of <br />real property; and evaluation of a public officer or employee, respective- <br />ly and l1s. Kissler seconded the motion, which passed una~imously (10:20 <br />p.m.). <br /> <br />Mr. Farr moved the Council reconvene at 11:24 p.m. and Ms. Kissler se- <br />conded the motion, which passed unanimously. <br /> <br />Mr. Farr moved to remove Item 17C from the table and Ms. Kissler seconded <br />the motion, which passed unanimously. <br /> <br />Mr. Guerra introduced a discussion and direction to Staff regarding a <br />tenative agreement on the jurisdictional boundaries of the Cities of <br />San Marcos and Kyle (Item 17C). The Council directed Staff to set <br />up a schedule for no more than three Council Members at a time to <br />go on-site of the property in question.
