These covenants <br />may be amended only with the written consent of Master Developer and Owner and the <br />City. Master Developer and/or Owner may assign its right to consent to any amendment <br />hereunder by written instrument executed by Master Developer or Owner and recorded in <br />the Official Public Records of Hays County, Texas. <br /> <br />15.3 The Master Developer and Owner understands and acknowledges that any person, firm, <br />corporation or other entity violating any provisions of these development standards shall be <br />subject to a suit by the City and/or the Property Owners Association for an injunction to <br />enjoin the violation of these development standards as restrictive covenants, and as though <br />they were conditions, restrictions and limitations on use of the Property under the City's <br />zoning ordinance. <br /> <br />15.4 All obligations of the Master Developer and Owner created under these development <br />standards are performable in Hays County, Texas and venue for any action arising under <br />these development standards shall be in Hays County, Texas. <br /> <br />15.5 Nothing in these development standards, express or implied, is intended to confer any <br />rights, benefits or remedies under or by reason of these development standards upon any <br />person or entity other than the City of San Marcos. <br /> <br />15.6 In case one or more provisions of these Development Standards are deemed invalid, illegal <br />or unenforceable in any respect, such invalidity, illegality or unenforceability shall not <br />affect any other provisions hereof and in such event, these Development Standards shall be <br />construed as if such invalid, illegal or unenforceable provision had never been contained <br />herein. <br /> <br />15.7 Words and terms used herein, not specifically defined in these Development Standards, <br />shall have their meaning as defined in the San Marcos City Code, or if not defined therein, <br />shall have their usual and ordinary meaning.
