<br />I <br /> <br />(b) An action or inaction is "reasonable and effective" if it in any way contributes <br />or could be reasonably be thouoht to contribute to preservino any lives or <br />property. <br /> <br />(c) This section shall prevail over every other ordinance of the city and. to the <br />extent to which the city has the authority to so authorize, over any other law <br />establishino a standard of care in conflict with this section. <br /> <br />(d) Neither the city nor any of its employees. aoents, or officers, nor other unit of <br />oovernment or oovernment subdivision nor its emplovees, aoents, or officers <br />may be held liable for the failure to use ordinary care durinq an emeroencv. <br /> <br />(e) It is the intent of the city council. by passino this ordinance, to assure <br />effective action in emeroencv situations bv those entrusted with the responsibilitv <br />of savino lives and property bv protectino such oovernmental units from liability, <br />and their employees, aqents. and officers from non-intentional tort liability to the <br />fullest extent permitted by statutory and constitutional law. <br /> <br />(f) This section shall be liberally construed to carry out the intent of the city <br />council. <br /> <br />I Sec. 26.028. Liability. <br /> <br />This chapter is an exercise bv the city of its oovernmental function for the <br />protection of the public peace, health, and safety. Neither the City of San <br />Marcos. it's the officers. emplovees, aqents. and representatives, nor any <br />person, who is in oood faith carryinq out. complyinq with. or attemptinq to comply <br />with, any order, rule, or reoulation promuloated pursuant to the provisions of this <br />chapter shall be liable for any damaoe sustained to persons as the result of such <br />activity. <br /> <br />Sec. 26.029. No liability for operation of shelters. <br /> <br />I <br /> <br />(a) Notwithstandinq the fact that most public and privately owned buildinos within <br />the city were not desioned and constructed to withstand the forces of nature that <br />may be present in severe weather conditions or other manmade disasters, and <br />may not be any more suitable than residential homes: and, because of the <br />public's desire that public shelters be made available to them. the city manaoer <br />may provide shelter in buildinqs that are owned. leased, or otherwise made <br />available to the city as refuoes of last resort. These refuoes of last resort may be <br />made available for use by residents and visitors to the city in anticipation of any <br />disaster (all hazards) and specificallv durino the occurrence of severe weather <br />within the city.
