<br />(3) <br /> <br />Minimum Rear Yard: <br /> <br />~2Jeet, with an additional 2 feet required <br />for each story above 24 feet, up to a <br />maximum setback of25 feet; there shall be <br />no encroachment or overhangs into this <br />required rear yard <br /> <br />SECTION 31. Section 4.2.5.1(b)(3) and (4) and (d) of the City Land Development Code <br />are amended as follows (underlining indicates added text; oyer strike indicates deleted text): <br /> <br />Section 4.2.5.1 <br /> <br />HD, Historic District <br /> <br />(b) Establishment of Local Historic Districts. <br /> <br />(3) Copies of the report shall be transmitted for review and recommendation <br />to the Planning and Zoning Commission; and to the State Historical <br />Commission. SHay 30 days or more after the transmittal, the Historic <br />Preservation Commission shall hold a public hearing on the establishment <br />of the proposed district. Notice of the public hearing will be published in a <br />newspaper of general circulation in the City, and a written notice of the <br />public hearing will be mailed to the owners of all properties to be included <br />in the district, at least ten days before the hearing in accordance with <br />Article 3, Division 2 of Chapter I. <br /> <br />(4) <br /> <br />After the public hearing, the Historic Preservation Commission shall <br />submit a final report with its recommendations and those of to the <br />Planning and Zoning Commission and a draft of a proposed ordinance to <br />the City Council for its action. Subsequent to action by the Planning and <br />Zoning Commission, a final report including the recommendations of both <br />bodies and a draft of a proposed ordinance will be forwarded to the City <br />Council for action. <br /> <br />(d) Authorized Uses. Permitted and conditional uses, as authorized in the base <br />zoning district in the Land Use Matrix in Article 3, Division 1 of this Chapter 4. <br />Accessory uses as authorized in Article 3, Division 2 of this Chapter 4. <br />Industrialized and m Manufactured homes are not permitted in the Historic <br />District. <br /> <br />SECTION 32. Section 4.2.7.5(b) of the City Land Development Code is amended as <br />follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Section 4.2.7.5 <br /> <br />Transfer of Non-Residential Square Footage <br /> <br />(b) <br /> <br />Maximum Square Footage Transferred.
