<br />I <br /> <br />I <br /> <br />I <br /> <br />concerning the new or unlisted use to the Planning and Zoning <br />Commission and request a recommendation as to the zoning classification <br />into which such use should be placed. <br /> <br />a. The Planning Director shall refer the question concerning any new <br />or unlisted use to the Planning and Zoning Commission requesting <br />a recommendation as to the zoning classification into which the <br />use should be placed. The referral shall be accompanied by the <br />statement of facts in subsection (d)(l)a of this section. <br /> <br />b. The Planning and Zoning Commission shall consider the nature <br />and described performance of the use and its compatibility with the <br />uses permitted in the various districts, and determine the zoning <br />district or districts within which the use is most similar, and should <br />be permitted and if such use shall be permitted by right or by CUP. <br /> <br />c. The Planning and Zoning Commission shall transmit its findings <br />and recommendations to the City Council as to the classification <br />proposed for any new or unlisted use. If such recommendation is <br />in response to an appeaL the Commission's recommendation shall <br />be final. <br /> <br />d. <br /> <br />The City Council shall approve or disapprove the recommendation <br />of the Planning and Zoning Commission or make such <br />determination concerning the classification of such use as is <br />determined appropriate based upon its findings. If approved, the <br />new or unlisted use shall be amended in the Land Use Matrix of <br />the regulations according to procedures outlines in Chapter I (i.e., <br />following notification and public hearing, etc.). <br /> <br />SECTION 34. The Land Use Matrix table included in Section 4.3.1.2 of the City Land <br />Development Code is amended to read as shown in the attached table labeled "Section 4.3.1.2 <br />Land Use Matrix". <br /> <br />SECTION 35. Section 4.3.2.1(h) of the City Land Development Code is amended as <br />follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Section 4.3.2.1 <br /> <br />Area Regulations for Accessory Buildings in Single-Family and <br />Two-Family Districts <br /> <br />(h) See Article 4, Division 2. ~ for exterior construction standards for accessory <br />buildings. <br /> <br />SECTION 36.
