Sections 7.1.5.1 and 7.1.5.2 of the City Land Development Code are <br />amended as follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Section 7.1.5.1 <br /> <br />Interlocal Cooperation Agreements between San Marcos and <br />Hays, Comal and Guadalupe Counties <br /> <br />The City has executed separate interlocal cooperation agreements as authorized under <br />Chapter 242 of the Texas Local Government Code. These agreements are with Hays, <br />Comal and Guadalupe Counties. Each county has assigned the City its respective <br />authority to approve subdivision plats in the City's ETJ. The agreements generally <br />provide for the City to enforce its subdivision regulations, together with specified <br />regulations of the respective counties, within the ETJ. (For specific responsibilities, see <br />the separate interlocal agreements found in the Technical Manual.) <br /> <br />Section 7.1.5.2 <br /> <br />Interlocal Cooperation Agreement between San Marcos and <br />Caldwell County <br /> <br />The City has executed a separate interlocal agreement as authorized under Chapter 242 <br />of the Texas Local Government Code with Caldwell County. Caldwell County has <br />assigned its authority to approve subdivision plats in the City's ETJ to the City. The <br />agreement generally provides for the City to enforce its subdivision regulations and <br />authority within the ETJ, with the exception that Caldwell County shall continue to <br />administer its on-site sewage and floodplain regulations and assume maintenance <br />responsibility for all public streets, roads, and drainage systems upon their completion <br />within subdivisions in the City's ETJ. (For specific responsibilities, see the separate <br />interlocal agreements found in the Technical Manual). <br /> <br />SECTION 60. Section 7.2.1.3(b) of the City Land Development Code is amended as <br />follows (underlining indicates added text; overstrike indicates deleted text): <br /> <br />Section 7.2.1.3 <br /> <br />Individual Wells <br /> <br />(b) Within the ET J. Individual wells within the ETJ shall be subject to approval by <br />the coun-ty City health official, and this approval shall be documented by the health <br />official's signature on the water system statement on the plat. The developer must submit <br />with the plat application a certificate from a professional engineer registered in this state <br />or a geoscientist licensed to practice in this state verifying the adequacy of the proposed <br />source of well supply prior to plat approval. <br /> <br />SECTION 61.
