The City staffhas recommended that water and wastewater impact fees be waived for new <br />single-family dwelling construction projects of Habitat for Humanity and the San Marcos Housing <br />Authority. <br /> <br />2. The City Council wishes to amend the City Code to implement this recommendation. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 86.309 of the City Code is amended as follows (underlining indicates <br />added text; o'lerstrike indicates deleted text): <br /> <br />Sec. 86.309. Exceptions and Exemptions. <br /> <br />(a) To encourage affordable housing, the city shall refund a percentage of the impact fees <br />paid for construction of a new single-family dwelling that qualifies for the refund under <br />affordable housing guidelines approved by the city council. In addition. the construction of <br />new single-family dwellings by Habitat for Humanity. San Marcos. Texas Chapter. and by <br />the San Marcos Housing Authority is exempt from water and wastewater impact fees. <br /> <br />(b) Impact fees shall not be collected from any local taxing unit, as defined in the state Tax <br />Code, that is authorized to impose and is imposing ad valorem taxes on property. <br /> <br />(c) No wastewater impact fee shall be charged for an irrigation meter. <br /> <br />(d) No impact fee shall be charged for a fire line meter that serves only a fire suppression <br />system. <br /> <br />(e) To encourage water-efficient development, the city shall refund a percentage of the <br />impact fees paid for construction of a new single-family dwelling that qualifies for the refund <br />under water conservation guidelines approved by the city council. <br />
