SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of <br />the San Marcos City Code, is amended to rezone the following real property (the "Property") <br />which is presently zoned "R-1" Single-Family Dwelling District (Low Density) to "CC" <br />Community Commercial District with a "PDD" Planned Development District overlay, subject to <br />the provisions of the land use plan and development standards described in Section 2 of this <br />ordinance: <br />Street address: 508 Craddock Avenue <br />Size: 9.94 acres, more or less <br />Legal description: See the metes and bounds description attached as Exhibit A <br />Deed or plat reference: Volume 187, Page 217, Hays County Deed Records <br />SECTION 2. The PDD Land Use Plan (the "Land Use Plan") for the Fairway Driving <br />Range Planned Development District, attached to this ordinance as Exhibit B, and the Planned <br />Development District Development Standards (the "Development Standards") for the Fairway <br />Driving Range Planned Development District, attached to this ordinance as Exhibit C, are <br />approved and adopted to regulate the development of the Property. The Property will be bound <br />by the provisions of the Land Use Plan and the Development Standards as though they were <br />conditions, restrictions and limitations on use of the Property under the City's zoning ordinances. <br />Any person, firm, corporation or other entity violating any provisions of the Land Use Plan or <br />the Development Standards shall be subject to all penalties that apply to violation of the zoning <br />ordinances of the City of San Marcos, as amended. Any person, firm, corporation or other entity <br />violating any provisions of the Land Use Plan or the Development Standards shall be subject to a <br />suit by the City for an injunction to enjoin the violation as though the Land Use Plan and <br />Development Standards were conditions, restrictions and limitations on use of the Property under <br />the City's zoning ordinances. <br />SECTION 3. The future land use map of the City, included in the Horizons City Master <br />Plan adopted in Section 3.1.1.1 of the LDC, is amended on an interim basis to conform to the <br />rezoning described in Section 1 of this ordinance, and to designate the Property as "CC" <br />Community Commercial on an interim basis in connection only with the golf practice facility use <br />of the Property described in the Development Standards. The Sector Two Plan approved in <br />Ordinance No. 2001-53 is amended on an interim basis by adding the following note at the end <br />of the "Community Shopping & Professional Center" detailed planning area description on pages <br />3-9 and 3-10: <br />Note: A 9.94 acre, more or less, portion of the Weatherford tract has been rezoned from <br />"R-1" Single-Family Dwelling District (Low Density) to "CC" Community Commercial <br />District with a "PDD" Planned Development District overlay in connection with a golf <br />practice facility that the property owner intends as a temporary use of the property. The <br />PDD overlay included, as Development Standards, extensive restrictions on the use of the <br />rezoned property.
