05011802 OFR 2676 755 <br />Property. Netting shall be designed and installed by a qualified netting company. The height of <br />netting may be adjusted with the approval of the Planning Director. <br />4.09. Garbage Dumpster. A location shall be designated for the garbage dumpster to be <br />accessible from Archie Street for weekly pick-up. The location shall be fenced with a cedar <br />fence and landscaped on three sides to enhance appearance. The dumpster area shall be placed <br />on a concrete pad conforming to City standards. <br />4.10. Equipment Storage. All golf practice facility equipment and all maintenance equipment <br />shall be stored out of sight when not being used. <br />4.11. Parking Area. The parking area shall not include curbs except at the entrance. The <br />parking area will be graded to maintain current contours as not to change surface water patterns. <br />The parking area shall conform to City standards unless otherwise approved by the Planning <br />Director. <br />4.12. Signage. Signage shall be limited to a sign located at the corner of Craddock and RR 12 <br />and a sign attached to the building. The sign located at the corner of Craddock and RR 12 shall <br />be no larger than 24 sq. ft. (one side), double sided if needed, shall not be lit, and shall be located <br />on private property in compliance with City standards. The sign on the building shall meet city. <br />4.13. Maintenance. The Property and all improvements on the Property shall be maintained in <br />clean, orderly condition at all times. Trash shall be removed from the grounds and from the trash <br />containers at least once on each day of operation. <br />Part 5. Miscellaneous <br />5.01. Effect of Standards as Zoning Restrictions. The Property Owner understands and <br />acknowledges that the Property will be bound by the provisions of these development standards <br />as though they were conditions, restrictions and limitations on use of the Property under the <br />City's zoning ordinances. These conditions, restrictions and limitations on use of the Property <br />bind the current owner and all successors. <br />5.02. Standards as Restrictive Covenants. The Property Owner, as fee simple owner of the <br />Property, in consideration for the City's approval of the rezoning of the Property, including these <br />Development Standards as an integral part thereof, declares and establishes the following <br />restrictive covenants on the Property in favor of the City. The Property Owner, on behalf of itself <br />and its successors and assigns with respect to ownership of the Property, covenants and agrees to <br />comply with all provisions of these Development Standards. The Property Owner and the City <br />stipulate that 1) this covenant touches and concerns the Property, 2) notice will be given by filing <br />of this instrument in the public records of Hays County, Texas, and 3) these covenants are <br />reasonable in connection with the Project. These covenants run with the title to the Property and <br />are binding on the Property Owner and the Property Owner's successors and assigns. These <br />covenants may be amended only with the written consent of the City. <br />Page 4 of 6 of Exhibit C
