<br />5. confIrm the specific type of decision, permit or approval that is <br />required by the city for the development under the city Land <br />Development Code before the development is initiated. <br /> <br />The responsible official shall presume that an application provides "fair notice of the <br />project and the nature of the decision, permit or approval sought" if the application is <br />submitted on the proper application form promulgated by the City in the Technical <br />Manual. is accompanied by all required attachments, and reasonably appears to be <br />complete. <br /> <br />(2) Protect means a development that requires a decision, permit or approval by the <br />city under the city Land Development Code before it is initiated. <br /> <br />SECTION 2. Chapter 86, Utilities, of the City Code is amended by renumbering Section <br />86.002 as Section 86.001, and by adding a new Section 86.002 to read as follows: <br /> <br />Sec. 86.002. Processing of applications for water or wastewater service, water or <br />wastewater connections, and water or wastewater line extensions. <br /> <br />(a) Definitions. In this section: <br /> <br />(1) Application means a written application to initiate service from a city water or wastewater <br />line, an application for connection to a city water or wastewater line, or an application for <br />extension of a city water or wastewater line, whether the water or wastewater line is within or <br />outside the city limits. <br /> <br />(2) Fair notice of the project and the nature of the development to be served by the utility <br />service, utility connection or utility extension means a written description ofthe development, <br />accompanied by sufficient written information for the director to determine all of the <br />following: <br /> <br />1. The site of the proposed development, including its physical location and size; <br />2. The nature of the proposed development, in sufficient detail to be able to: <br />a. determine the physical characteristics of the development (e.g., fill or <br />excavation, building construction, public infrastructure installation or <br />improvement); <br />b. determine the nature and extent of public facilities or infrastructure, if any, <br />that would be associated with or impacted by the development; <br />c. confIrm that the proposed development requires a decision, permit or <br />approval by the city under the Land Development Code before the <br />development is initiated; and <br />d. confirm the manner in which the proposed development contributes to <br />completion of the project for which the decision, permit or approval is <br />sought, if the development is part of a larger project; and <br /> <br />8 <br />
