<br />e. confirm the specific type of decision, permit or approval that is required by <br />the city for the development under the Land Development Code before the <br />development is initiated. <br /> <br />The director shall presume that an application provides "fair notice of the project and the <br />nature of the development to be served by the utility service, utility connection or utility <br />extension" if the application is submitted on the proper application form promulgated by the <br />city, is accompanied by all required attachments, and reasonably appears to be complete. <br /> <br />(3) Project means a development that requires a decision, permit or approval by the city <br />under the Land Development Code before it is initiated. <br /> <br />(4) Project-related application means an application for approval of a development that <br />requires a decision, permit or approval by the city under the Land Development Code before it <br />is initiated. <br /> <br />(5) Director means the director of the water and wastewater department, or the director's <br />authorized representative. <br /> <br />(b) Initial review of applications by director. The director shall review each application to <br />determine whether it is a project-related application. If not, the director shall accept and <br />process the application. If so, the director shall accept the application for filing only if the <br />application gives the director fair notice of the project and the nature of the development to be <br />served by the utility service, utility connection or utility extension. If the application gives fair <br />notice of the project and the nature of the development to be served by the utility service, <br />utility connection or utility extension, the director shall accept the application for filing, and <br />transmit a copy of the application to the director of planning and development services and the <br />director of engineering. If the director determines that an application does not give fair notice <br />of the proj ect and the nature of the use to be served by the utility service, utility connection or <br />utility extension, the director shall not accept the application for filing, and shall request <br />clarification from the applicant. <br /> <br />(c) Review of applications for completeness. The director shall review for completeness each <br />project-related application using the procedures and criteria in Section 1.3.1.1 of the Land <br />Development Code. <br /> <br />(d) Processing of applications. The director shall process each project-related application <br />using the applicable procedures and criteria contained or referenced in the Land Development <br />Code. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to <br />be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4.
