<br />, <br /> <br />tI <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 6 Platting Procedures <br /> <br />(2) Use of existing cemeteries complying with all State and local laws and <br />regulations; <br /> <br />(3) A division of land created by order of a court of competent jurisdiction; <br /> <br />(4) A division of land that results in the creation of two or more parcels, each of <br />which is greater than five acres inside the City limits, or each of which is <br />greater than ten acres within the City's extraterritorial jurisdiction, when each <br />parcel has direct access to an existing public street, and no dedication of <br />public facilities is required under this Land Development Code in connection <br />with the division; and <br /> <br />(5) Creation of a remainder tract. <br /> <br />(b) The following development activities are exempt from the requirements of this article <br />that apply to development plats: <br /> <br />(1) Any development activity associated with a subdivision plat that conforms to <br />the requirements set forth in divisions 3 and 5 of this chapter; <br /> <br />(2) Sale, inheritance, or gift of land by metes and bounds of tracts upon which no <br />improvements, development, subdivision or alteration is intended; <br /> <br />(3) Use of existing cemeteries complying with all State and local laws and <br />regulations; <br /> <br />(4) Bona fide agricultural activities; <br /> <br />(5) Construction of agricultural accessory structures and related development <br />activities; and <br /> <br />(6) Construction of a single-family dwelling and related accessory structures and <br />development activities. <br /> <br />City of San Marcos, Texas <br /> <br />1-89 <br /> <br />Land Development Code - Final <br />
