<br />41 <br /> <br />41 <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 6. Platting Procedures <br /> <br />(1) The plat conforms to the general layout of the Subdivision Concept Plat and is <br />consistent with the phasing plan approved therein; <br /> <br />(2) The proposed provision and configuration of roads, water, wastewater, <br />drainage and park facilities, and easements and rights-of-way are adequate to <br />serve the subdivision and meet applicable standards of Chapters 6 and 7 of <br />this Land Development Code; <br /> <br />(3) The plat conforms to the approved Watershed Protection Plan (Phase I); and <br /> <br />(4) The plat meets any county standards to be applied under an interlocal <br />agreement between the City and a county under Tex. Loc. Gov't Code ch. <br />242, where the proposed development is located in whole or in part in the <br />extraterritorial jurisdiction of the City and in the county. <br /> <br />Section 1.6.3.6 <br /> <br />Expiration <br /> <br />The approval of a Preliminary Subdivision Plat application shall remain in effect for a period of <br />one year from the date the application was approved or conditionally approved by the Planning <br />and Zoning Commission, during which period the applicant shall submit and receive approval for <br />a final Subdivision Plat for the land subject to the Preliminary Subdivision Plat. If a final <br />Subdivision Plat application has not been approved within the one-year period, the Preliminary <br />Subdivision Plat approval, unless extended in accordance with Article 3, Division 5 of this <br />Chapter 1, shall expire and the plat shall be null and void. <br /> <br />Section 1.6.3.7 <br /> <br />Revisions Following Approval of Preliminary Subdivision Plat <br /> <br />(a) Minor Changes. Minor changes in the design of the subdivision subject to a <br />Preliminary Subdivision Plat may be incorporated in an application for approval of a <br />Final Subdivision Plat without the necessity of filing a new application for approval <br />of a Preliminary Subdivision Plat. Minor changes shall include adjustment in street <br />or alley alignments, lengths, and paving details, and adjustment of lot lines that do not <br />result in creation of additional lots, provided that such changes are consistent with <br />any approved priority applications. <br /> <br />(b) Amendments. All other proposed changes to the design of the subdivision subject to <br />an approved Preliminary Subdivision Plat shall be deemed major amendments that <br />require submittal and approval of a new application for approval of a Preliminary <br />Subdivision Plat before approval of a Final Subdivision Plat. Approval of major <br />revisions to an approved Preliminary Subdivision Plat shall occur prior to the date <br />any approved Subdivision Concept Plat would have expired for the same land. <br /> <br />City of San Marcos, Texas <br /> <br />Land Development Code - Final <br /> <br />1-99 <br />
