Preliminary Development Plat, unless the applicant has elected to <br />eliminate this stage of the platting process; and <br /> <br />d. Construction plans. <br /> <br />(b) Accompanying Applications. <br /> <br />(1) An application for approval of a Final Subdivision Plat may be accompanied <br />by an application for approval of a Site Preparation Permit for one or more <br />proposed lots, provided that the Final Subdivision Plat shall be decided prior <br />to decision on any Site Preparation Permit. <br /> <br />(2) An application for approval of a Final Development Plat may be accompanied <br />by an application for approval of a Site Preparation Permit for the land subject <br />to the plat, provided that the Final Development Plat shall be decided prior to <br />decision on any Site Preparation Permit. <br /> <br />Section 1.6.5.3 <br /> <br />Application Requirements <br /> <br />(a) Responsible Official. The Planning Director shall be the responsible official for a <br />Final Subdivision Plat or a Final Development Plat. <br /> <br />(b) Contents. An application for approval of a Final Development Plat shall be prepared <br />in accordance with Chapter 1 of the Technical Manual. <br /> <br />(c) Consent of Lienholders. The applicant shall furnish with the application to the City a <br />current title commitment issued by a title insurance company authorized to do <br />business in Texas policy, or a title opinion letter from an attorney licensed to practice <br />in Texas, identifying all persons having an interest in the property subject to the plat, <br />including lienholders. The applicant shall submit a written agreement executed by <br />each lienholder consenting to the platting of the property and to the dedications and <br />covenants that may be contained in the plat. The title commitment or title opinion <br />letter and consent agreement shall be subject to review and approval by the City <br />Attorney. <br /> <br />Section 1.6.5.4 <br /> <br />Decision <br /> <br />(a) Decision. The Planning and Zoning Commission shall decide whether to approve, <br />approve with conditions, or deny the final Subdivision Plat or Final Development <br />Plat application. The Commission also shall decide any appeal of the Engineering <br />Director's decision on construction plans. <br /> <br />(b) Certification. A notation of the action taken on each Final Subdivision Plat or final <br />Development Plat application and the reasons therefore shall be entered in the <br />minutes of the Planning and Zoning Commission.
