<br />41 <br /> <br />41 <br /> <br />I <br /> <br />Chapter l' Development Procedures - Article 7 Watershed Protection Plans <br /> <br />I ARTICLE 7: WATERSHED PROTECTION PLANS I <br /> <br />Division 1: Approval and Application Process; Appeals <br /> <br />Section 1.7.1.1 <br /> <br />Purpose, Applicability, Exceptions and Effect <br /> <br />(a) Purpose. The purpose of a Watershed Protection Plan shall be to apply the <br />environmental and flood control standards contained in Chapter 5 to a conceptual <br />development design. A Watershed Protection Plan assures that such standards will be <br />met at the time of development of the property by establishing terms and conditions <br />for approval of applications for plats and Site Preparation Permits. For purposes of <br />this Code, an Aquifer Protection Plan and a Site Plan for land in the San Marcos <br />River Corridor which was under prior regulations for or in association with a plat <br />application are Watershed Protection Plans. <br /> <br />(b) Applicability. Except as provided in subsections (c) or (d), approval of a Watershed <br />Protection Plan is required within the City limits or within the City's extraterritorial <br />jurisdiction prior to approval of a plat application or, for developments where a plat <br />already has been approved for the property, prior to approval of a Site Preparation <br />Permit. A Watershed Protection Plan shall include all land contiguous to and in the <br />same ownership with the land subject to the plat application or Site Preparation <br />Permit, except a remainder tract. <br /> <br />(c) Option. For a tract, parcel or lot for which division is not required or intended prior <br />to development, a property owner may elect to apply for approval of a development <br />plat under Article 6 of this Chapter I in lieu of applying for a Watershed Protection <br />Plan. <br /> <br />(d) Exceptions. A Watershed Protection Plan is not required for any land that is <br />expressly exempted from the environmental standards contained in Chapter 5, <br />Articles 1-4 of the Land Development Code. <br /> <br />(e) Effect. Approval of a Watershed Protection Plan entitles the applicant to seek <br />approval of a Cluster Development Plan, plat application or Site Preparation Permit, <br />as the case may be. <br /> <br />City of San Marcos, Texas <br /> <br />1-123 <br /> <br />Land Development Code - Final <br />
