<br />~ <br /> <br />41 <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 8 Site Preparation Permits <br /> <br />(2) Partial exemptions - zoning regulations. The following proposed land uses or <br />activities are exempt from Site Preparation Permit requirements related to <br />compliance with Chapter 4, Zoning Regulations: <br /> <br />a. Agricultural uses; <br /> <br />b. Single-family and duplex, or two-family, residential uses (multi- <br />family, single-family attached, manufactured/mobile home, and <br />nonresidential development projects in single- or two-family <br />residential districts, such as churches, schools and day care facilities, <br />are not exempt); <br /> <br />c. Public utilities authorized to use City rights-of-way and public utility <br />easements by separate agreement or by state law; and <br /> <br />d. Existing nonresidential and multi-family uses that do not expand more <br />than 10% of the building's originally constructed floor area, and for <br />which any additional required parking is provided. <br /> <br />(3) Partial exemptions - environmental regulations. The following proposed land <br />uses or activities are exempt from Site Preparation Permit requirements <br />related to compliance with the standards in Chapter 5, Environmental <br />Regulations: <br /> <br />a. Any land subject to an approved development plat; <br /> <br />b. Any structure that is to be replaced or enlarged up to a maXImum <br />amount equal to 50% of the structure's original floor area; and <br /> <br />c. Agricultural uses. <br /> <br />(4) Partial exemptions - development standards. The following proposed land <br />uses or activities are exempt from Site Preparation Permit requirements <br />related to compliance with the development standards in Chapter 6: <br /> <br />a. Existing nonresidential and multi-family uses that do not expand more <br />than 10% of the building's originally constructed floor area, and for <br />which any additional required parking is provided; and <br /> <br />b. Agricultural uses. <br /> <br />(5) Partial exemptions - public facilities standards. The following proposed land <br />uses or activities are exempt from Site Preparation Permit requirements <br />related to compliance with the public facilities standards in Chapter 7: <br /> <br />a. Any land subject to an approved development plat; and <br /> <br />b. Existing platted lots where no site improvements are proposed. <br /> <br />(d) Effect. Approval of a Site Preparation Permit authorizes site preparatory activities <br />other than construction or placement of a structure on the land, subject to the terms of <br /> <br />City of San Marcos, Texas <br /> <br />1-131 <br /> <br />Land Development Code - Final <br />
