<br />4 <br /> <br />.II <br /> <br />J <br /> <br />Chapter 1 Development Procedures - Article 9 Construction Permits <br /> <br />construction codes included or adopted in Chapters 14 or 38 of the City Code, in which case such <br />appeal shall be made to the Construction Board of Adjustment (CBOA). The ZBOA shall decide <br />the appeal in accordance with Article 10. <br /> <br />Section 1.9.3.5 <br /> <br />Criteria for Approval <br /> <br />(a) The building official or the Zoning Board of Adjustments on appeal shall apply the <br />following criteria in deciding the application for a certificate of occupancy: <br /> <br />(1) The location of the structure on the property is in accordance with the <br />approved application for the building permit; <br /> <br />(2) Where a change of use in an existing structure is proposed, the use conforms <br />to the use regulations governing the property; <br /> <br />(3) Where occupancy of a manufactured home rental community is proposed, the <br />community has been designed and constructed in conformity with the <br />requirements of Chapter 4, Article 2, Division 1. <br /> <br />(4) The structure, following inspection by the building official, was built in <br />conformity with the Building Code, as incorporated in the City Code of <br />Ordinances, as may be modified from time to time. <br /> <br />(5) There are no outstanding permit requirements. <br /> <br />Section 1.9.3.6 <br /> <br />Revocation of Certificate <br /> <br />The building official may institute proceedings to revoke a certificate of occupancy under Article <br />3, Division 7 of this Chapter 1, whenever the official determines that the certificate has been <br />issued in error, or on the basis of incorrect information supplied, or that the use, dimensions, or <br />other feature of the structure authorized for occupancy, or any portion thereof, is in violation of <br />any provision of this Land Development Code or the Building Code or other construction codes <br />included or adopted in Chapter 14 of the City Code. <br /> <br />Division 4: Floodplain Permit <br /> <br />Section 1.9.4.1 <br /> <br />Purpose, Applicability and Effect <br /> <br />(a) Purpose.
