<br />Chapter 1 Development Procedures - Article 9 Construction Permits <br /> <br />(b) Applicability. Approval of a Floodplain Permit is required prior to construction of <br />any structure in an area of special flood hazard, or in any other 100-year floodplain <br />located within the City limits or the City's extraterritorial jurisdiction. For land <br />located in the City's extraterritorial jurisdiction, authorization for construction IS <br />granted by the Floodplain Administrator for the county in which the property IS <br />located under interlocal agreement. <br /> <br />(c) Effect. Within the City limits, approval of a floodplain Permit authorizes the <br />property owner to seek approval of an application for a building permit or certificate <br />of occupancy, in the case of a change in use for a structure. Outside the City limits, <br />approval of a Floodplain Permit authorizes the property owner to construct, alter, or <br />place a structure in the floodplain in accordance with the terms of the permit. <br /> <br />Section 1.9.4.2 <br /> <br />Application Requirements <br /> <br />(a) Responsible Official. The Engineering Director, acting in the capacity of Floodplain <br />Administrator, is the responsible official for an application for a Floodplain Permit. <br /> <br />(b) Contents. An application for approval of a floodplain Permit shall be prepared in <br />accordance with Chapter I of the Technical Manual. <br /> <br />Section 1.9.4.3 <br /> <br />Decision <br /> <br />(a) Decision. The Engineering Director shall approve, conditionally approve or deny the <br />application for a Floodplain Permit, unless the application is accompanied by a <br />variance petition, in which case the Director shall prepare a report and <br />recommendation to the Planning and Zoning Commission for decision on the <br />application and petition. <br /> <br />(b) Time for Decision. The application for a Floodplain Permit shall be decided within <br />ten working days of the official filing date if the Director decides the application. <br />Where a petition for variance has been filed, the application and the variance petition <br />shall be decided by the Commission within 30 days of the official filing date. <br /> <br />Section 1.9.4.4 <br /> <br />Appeal and Relief Procedures <br /> <br />(a) Appeal. Any interested person may appeal the Engineering Director's decision on a <br />Floodplain Permit to the Planning and Zoning Commission in accordance with <br />Article 10, Division I of this Chapter I. The appeal shall be supported by the <br />statement of a registered professional engineer.
