<br />Chapter 1 Development Procedures - Article 9 Construction Permits <br /> <br />shall report granting of any variances for uses in areas of special flood hazard to the <br />Federal Emergency Management Agency upon request. <br /> <br />(e) Vested Rights Petition. The applicant may file a vested rights petition with the <br />application for a Floodplain Permit. The petition shall be decided in accordance with <br />the procedures in Article 10, Division 4 of this Chapter I. <br /> <br />(f) Omnibus Relief Petition. The applicant may file an omnibus relief petition with the <br />application for a Floodplain Permit following the Engineering Director's decision and <br />resolution of any appeals on the application for a Floodplain Permit. The petition <br />shall be processed and decided in accordance with the procedures in Article 10, <br />Division 5 of this Chapter 1. <br /> <br />Section 1.9.4.5 <br /> <br />Criteria for Approval <br /> <br />(a) The Engineering Director, or the Planning and Zoning Commission on appeal, shall <br />decide whether to approve, conditionally approve or deny a Floodplain Permit <br />application based upon the following criteria: <br /> <br />(1) The application is consistent with the approved Site Preparation Plan; <br /> <br />(2) The application meets the standards of Chapter 5, Article 4, Division 3. <br /> <br />Section 1.9.4.6 <br /> <br />Expiration <br /> <br />(a) A Floodplain Permit, unless extended or reinstated under Article 3, Division 5 of this <br />Chapter 1, shall expire one year from the date of approval if construction has not <br />commenced, or two years from the date of approval, if construction has not been <br />completed. <br /> <br />City of San Marcos, Texas <br /> <br />Land Development Code - Final <br /> <br />1-142 <br /> <br />It <br /> <br />It <br /> <br />~ <br />
