<br />, <br /> <br />tI <br /> <br />J <br /> <br />Chapter 2 Development in the ETJ - Article 2 Development Agreements <br /> <br />(h) A schedule for providing public facilities and services to the development that <br />identifies the service provider and the approximate dates within which service will be <br />provided for each phase of the development. <br /> <br />(i) Identification of the means and provisions for financing each public service required <br />to support development of the property, including but not limited to impact fees, <br />contributions in aid of construction, dedication of rights-of-way for public <br />improvements, and construction of such improvements; <br /> <br />(j) A schedule for annexing the property to the City, together with any guarantees of <br />immunity from annexation, identifying the period during which the property may not <br />be annexed. <br /> <br />(k) The term of the agreement and provisions for extension, if any. <br /> <br />(I) Provisions for enforcement of the agreement by the City. <br /> <br />(m) Provisions for amending the agreement. <br /> <br />(n) Provisions for recording the agreement. The agreement shall be recorded in each <br />county in which some of the land subject to the agreement is located. <br /> <br />(0) Provisions assuring that the agreement shall bind successors-in-interest to the parties. <br /> <br />(p) Where development transfers are intended, assurances that the granting site will be <br />preserved. <br /> <br />Section 2.2.1.4 <br /> <br />Land Use Plan <br /> <br />(a) Purpose. The purpose of the land use plan that is to be incorporated into the <br />development agreement is to graphically depict the locations of authorized uses for <br />the land subject to the agreement, and to define prospective zoning district boundaries <br />and development standards for such areas. <br /> <br />(b) Relationship to Conceptual Plan. The land use plan shall be consistent with the <br />conceptual plan of development approved with the petition for the development <br />agreement. <br /> <br />(c) Consistency With Land Use Plan. Subsequent development applications shall be <br />consistent with the land use plan. <br /> <br />(d) Phasing and Development Standards. Unless expressly provided to the contrary in <br />the annexation agreement, only the initial phase of development shall be authorized <br />while the property is located outside the City limits.
